<br />r <br /> <br />, <br /> <br />.1\ <br />.~ <br /> <br />), <br /> <br />",-=-'< .' <br /> <br />~ <br /> <br />7-fl <br /> <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br />CITY OF SAN MARCOS <br /> <br />We, the undersigned authorities, DO HEREBY CERTIFY that none <br />of the wansnts being refunded by $31,000.00 CITY OF SAN MARCOS <br />WATERWORKS AND SEWER IMPROVEMENT REFUNDING BONDS, SERIES OF 1955, <br />dated March 1, 1955, were ever purchased by or held in the sinking <br />fund created for the payment and redemption of said warrants; that <br />none of said warrants are now held in or owned by the sinking fund <br />created for the purpose of paying off or redeeming said warrants; <br />that none of said warrants will be taken up and paid for with money <br />from said sinking fund; and that there is no money in the sinking <br />fund of the warrants being refunded with which to payoff any of the <br />principal of the warrants being refunded. <br />WE FURTHER CERTIFY that there has never been and is not now <br /> <br />pending any litigation in any wise affecting the validity of said <br /> <br />warrants being refunded nor has there ever been nor is there any <br /> <br />litigation now pending affecting the power of the City Council to <br />levy and collect taxes to pay the principal of and interest on same. <br />WE FURTHER CERTIFY that there are no suits now pending or <br />threatened in any way affecting the boundaries of the City of San <br />Marcos or the titles of the city officials of said City of San <br /> <br />Marcos to their respective offices. <br />WITNESS OUR HANDS and the seal of the City of San Marcos, Texas <br /> <br />this <br /> <br />,f.;?J day of <br /> <br />April, 1955. /1 <br /> <br />q/~. <br />-~ <br />V~7~ <br /> <br />(SEAL) <br />
