<br />19 <br /> <br />ORDINANCE 1981-32 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS ANNEXING TO SAID CITY A <br />CONTIGUOUS TRACT OF LAND CONTAINING APPROXI- <br />MATELY 57.67 ACRES OF LAND, MORE OR LESS, LO- <br />CATED WITHIN THE EXTRATERRITORIAL JURISDICTION <br />OF SAID CITY AND LYING ADJACENT TO PRESENT CITY <br />BOUNDARIES; EXTENDING THE BOUNDARY LIMITS OF <br />SAID CITY SO AS TO INCLUDE SAID TRACT; GRANTING <br />TO THE INHABITANTS OF SAID TRACT ALL THE RIGHTS <br />AND PRIVILEGES OF OTHER CITIZENS OF SAID CITY; <br />BINDING SAID INHABITANTS BY ALL OF THE ACTS AND <br />ORDINANCES, RULES AND REGULATIONS OF SAID CITY <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas <br />provided an opportunity for all interested persons to be heard <br />at a public hearing on February 23, 1981 on the annexation by <br />the City of San Marcos, Texas of approximately 57.67 acres, more <br />or less, out of the J.M. Veramendi League No.1, A-17 and the <br />James Curtis Survey A-3, Hays County Texas, being a portion of <br />that 38 acre tract described in a deed from Rogers C. Wilson, et <br />ux, to Rosemary Wilson McTaggart dated December 15, 1967 and re- <br />corded in Volume 221, Page 230 of the Hays County Deed Records and <br />being a portion of that 45 acre tract described in a deed from <br />Rogers C. Wilson, et ux, to Rogers D. Wilson dated December 15, <br />1967 and recorded in Volume 221, Page 232 and later corrected in <br />Volume 255, Page 208 of the Hays County Deed Records, and being <br />more particularly described by metes and bounds as follows: <br /> <br />BEGINNING at a fence corner post for the northerly <br />west corner of the McTaggart 38 acre tract, the apparent <br />north corner as fenced of that 0.381 acre tract described <br />in a deed from Jennie Wood Whaley to Southwestern Bell <br />Telephone Company, as recorded in Volume 124, Page 256 <br />of the Hays County Deed Records and being on the south- <br />east line as fenced of that 189 acre tract described <br />in a deed from W.E. Logan, et ux, to the State of Texas <br />dated June 24, 1946 as recorded in Volume 135, Page <br />414 of the Hays County Deed Records, and being in the <br />northwest line of a 10 foot aerial easement granted to <br />the Lower Colorado River Authority described in Volume <br />224, Page 522 of the Hays County Deed Records; <br /> <br />THENCE with the meanders of a fence for the cornmon line, <br />as fenced and used upon the ground, of the State of Texas <br />tract and the McTaggart tract the following five courses: <br /> <br />1. N45°00'00"E 2288.67 feet with the northwest line <br />of the aerial easement to a fence post for an <br />angle point, <br />2. N13°32'17"E 275.78 feet to a fence post for an <br />angle point, <br />3. N20034'08''E 10.71 feet to a fence post for an <br />angle point, <br />4. N57°56'50"E 110.63 feet to a fence post for an <br />angle point, <br />5. N58°24'35"E 147.44 feet to a fence post on the <br />approximate low bank of the San Marcos River for <br />the north corner of this tract and the McTaggart <br />tract; <br /> <br />THENCE with the approximate low bank of the San Marcos <br />River the following six courses: <br /> <br />1. S53°30'E 139.66 feet to an ~" iron rod set for an <br />angle point, pass at approximately 95 feet the <br />centerline of the aforereferenced LCRA easement, <br />2. S51046'30''E 26.17 feet to an ~" iron rod set for <br />an angle point, <br />3. S81P06'E 224&08 feet to an ~" iron rod set for an <br />angle point, <br />
