W. Mitchell Second Addition in Hays County, Texas, accord- <br />ing to the map or plat thereof, recorded in Volume liT", Page <br />393 of the Deed Records of Hays County, Texas, hereby re- <br />spectfully show: <br />HERETOFORE, by instrument dated April 18, 1891, <br />recorded in Volume 27, Pages 363-4 of the Deed Records of <br />Hays County, Texas, John F. McGehee and wife, dedicated or <br />conveyed to the City of San Marcos, a certain alley out of <br />a portion of Lot 1, in Block 9 of said L. W. Mitchell <br />Second Addition, said ~lley being described as follows: <br />BEGINNING at the North corner of said Lot No. One <br />on Burleson street; <br />TH~~CE about S. 45 deg. E. down the line between <br />Farm Lots 15 and 16 about 98 3/4 varas to Belvin Street; <br />THENCE S. 45 deg. W. with the line of Belvin Street <br />sixteen and one-half feet; <br />THENCE N. 45 deg. W. parallel to the first mentioned <br />line about 98 3/4 varas to Burleson Street; <br />THENCE N. 45 deg. E. 16 1/2 feet to the PLACE OF <br />BEGINNING. <br /> <br />Said tract of land has never been used as an alley <br />or street and has never been used for any public purpose <br />other than as a drain to carry water from Burleson Street to <br />lower sections of the town. <br />Your petitioners respectfully petition that.said <br />alley be vacated by the City of San Marcos, such vacation, <br />however, to be subject to the right on the part of the City <br />to continue to use said alley for the purpose of draining <br /> <br />- 1 - <br />
