<br />r <br />I~//F <br /> <br />I vi Mr. Barbee reported that Terry Jacks has furnished the title of property on High <br />Street, He has secured agreement from all property owners except the Smith property. <br />In order to get an agreement from the owner of this property, it will be necessary to <br />get a permit from an insurance company involved. Alderman Smith suggested that the <br />City proceed with the closing of the street~ and any matters arising from this could <br />be taken care of at the time they arise. Alderman Smith moved and Alderman DeViney saDnded <br />thattan ordinance be passed closing High Street. Vote was unanimo~. Ordinance follows these <br />m}nu ~ere was a short discussion on the library lot. Mr. Barbee reported that <br />the Baptist Church has appointed a committee to meet with the City's committee <br />to discuss this matter. The Council unanimously appointed Ernest Morgan, W. G. Bar- <br />bee and S. R. Beecroft to meet with the church committee as representatives of the <br />City. <br /> <br />o <br />en <br />~ <br />::.t:: <br />Q. <br /> <br />AN ORDINANCE AUDITING AND ALLOWING CLAIMS FOR INDEBTEDNESS INCURRED IN CON- <br />STRUCTING STREET IMPROVEMENTS IN THE CITY OF SAN MARCC6, TEXAS; AUTHORIZING THE <br />DELIVERY OF CITY OF SAN MARCOS STREET IMPROVEMENT WARRANTS. SERIES OF 1955. TO <br />EVIDENCE SAID INDEBTEDNESS; AND DECLARING AN EMERGENCY, was presented to the <br />Council for adoption. Alderman Smith made a motion that the ordinance be adopted, <br />Alderman Beecroft seconded the motion. A vote was taken which resulted unanimously <br />in favor of the motion. The ordinance follows these minutes and is a part hereof. <br /> <br />I <br /> <br />Mr. Barbee stated that the Army Reserve has again requested the City to donate <br />three or four acres of land in the City Park to be used for an armory or training <br />center. After a discussion, Alderman Allen made a motion that the City donate <br />3 to 4 acres of land from the City Park to the Army Reserve to be used as a <br />training cerreer location. Alderman De Viney seconded the motion. A vote was taken <br />which resulted unanimously in favor of the motion. <br /> <br />Mr. Barbee stated that Mr. A. F. ~eatherford has again requested that he be <br />furnished a sewer line to approximately four houses located on Highway 81 South. <br />He had previously talked with the council about such a sewer line, stating that <br />approximately ten years ago he had been promised by a City employee that he would <br />be furnished a sewer line, if he agreed to the annexation of his property~ In <br />1954 the City ran a sewer line across the back portion of Mr. Weatherford's property, <br />and, unknowingly did so without an easement. Mr. Weatherford has claimed that <br />damages were done to him, as his fence was torn down and his cattle were loose <br />on the highway. There has been some mention of possible suit against the City <br />for same. The Council, after discussion, unanimously agreed that the City could <br />not run a sewer line to Mr. Weatherford's property, because, if this were done, I <br />other property owners and sub-dividers would expect the same. It was the Council's <br />opinion that it could not be held responsible for a verbal promise which might have <br />been made ten years ago by some city employee, who probably did not have the <br />authority to make such a promise to begin with. The Council did agree, however, <br />to consider Mr. Weatherford's claim for damages which he believes were done to <br />his property. <br /> <br />Mr. Barbee reported that Mrs. D. E. Lockhart has not accepted the $250.00 <br />for damages which was offered to her by the City. He stated that she has advised <br />that she would sign a release if she were paid $800.00 for damages caused her <br />and her property by the overflow of the water storage tank. The Council discussed <br />this matter, after which, Mr. Barbee was instructed to send the check for $250.00 <br />to Mrs. Lockhart by registered mail. The Council suggested that a form of release <br />be typed on the back of the check above a place for Mrs, Lockhart's signature of <br />endorsement. The Council placed this' matter in the view that the City had already <br />repaired Mrs. Lockhart's property into better condition than it was before the tank <br />was built, therefore, it did not feel that the City owed her more than $250.00. <br /> <br />Mr. Barbee stated that Paul Guerrera has offered to sell his lot to the eity <br />for $550.00. The lot is Lot #9 of the J.P. Ellis Sub-Division and is located <br />at the end of Knox Street, making this street a dead-end. The lot is 50' x 120.13'. <br />Mr. Barbee stated that, if this lot could be purchased by the City, KnoX Street <br />could be opened into Ellis Street, Alderman Beecroft made a motion that the <br />Council approve the City's buying this lot from Paul Guerrera for $550.00. Alderman <br />Smith seconded the motion. A vote was taken which resulted unanimously in favor <br />of the motion. <br /> <br />I <br /> <br />There was a short discussion on hospitalization insurance for city employees. <br />Alderman Smith stated that lhe had made a review of the proposals submitted on <br />this insurance and now wished to turn the matter over to the Executive Secretary, <br />w. G. Barbee, for his consideration and final decision.
