<br />4 <br /> <br />ORDINANCE 1981-28 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF SAN MARCOS, TEXAS, <br />ORDERING A SPECIAL ELECTION ON <br />MAY 2, 1981, AND DECLARING AN <br />EMERGENCY. <br /> <br />WHEREAS, no candidate for Place 3 or Place 4 in the ~egular <br />City Election held April 4, 1981, received a majoyity bf the tbtal <br />vote, as required by Section 5.05 of the Charter of the City of <br />San Marcos, Texas; and, <br /> <br />WHEREAS, the two candidates receiving the largest number <br />of votes for Place 3 were John J. Stokes and John A. Kreczmer; <br />and, <br /> <br />WHEREAS, the two candidates receiving the largest number <br />of votes for Place 4 were Elida A. Mendez and Ed Tarbutton; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1: That a special election, to-wit: a <br />election, be held in said City on the 2nd day of May, <br />to determine the winning candidates for Place 3 and 4 <br />the San Marcos City Council. <br /> <br />runoff <br />1981, <br /> <br />on <br /> <br />SECTION 2: That, Janis Womack, be, and she is hereby, <br />appointed clerk for absentee voting. <br /> <br />SECTION 3: That, absentee voting for said runoff <br />election, be, held at City Hall, 630 East Hopkins Street within <br />said City. Said place of absentee voting shall remain open for <br />at least eight hours on each day for absentee voting which is <br />not a Saturday, a Sunday, or an official State holiday, beginning <br />on the 20th day and continuing through the 4th day preceding the <br />date of said election. Said place of voting shall remain open <br />between the hours of 8:00 a.m. and 5:00 p.m. on each day for said <br />absentee voting. The above described place for absentee voting <br />is also the absentee clerk's mailing address to which ballot <br />applications and ballots voted by mail may be sent. <br /> <br />SECTION 4: That, said runoff election be held in accordance <br />with the Texas Election Code and only resident qualified voters <br />of said City shall be eligible to vote at said election. <br /> <br />SECTION 5: That, notice of said election be given in <br />accordance with the Texas Election Code, and the City Secretary <br />is hereby instructed to have said notice posted and published in <br />accordance with said Article 4.05. <br /> <br />SECTION 6: That, immediately after said election is held, <br />the officers holding same shall make returns of the results <br />thereof to the Mayor of the City as required by the Texas <br />Election Code. <br /> <br />SECTION 7: That, a copy of this Ordinance shall also <br />serve as a writ of election which shall be delivered to the <br />Presiding Judges for said election. <br /> <br />SECTION 8: That, the importance of this Ordinance creates <br />an emergency and an imperative purpose necessary that the provisions <br />of the charter requiring that ordinances shall be read at three <br />
