<br />REGULAR MEETING OCTOBER 10, 1956

<br />On this, the lOth day of October, 1956, at 2:00 P. M., the City Council of
<br />the City of San Marcos, Texas met in a regular meeting at the City Hall in San
<br />Marcos with the following members present and participating:

<br />A quorum being present, the meeting was called to order by Alderman S. H.
<br />Beecroft and the following transpired:

<br />The first business to come before the Council was the matter of bids for
<br />work on the nevI Police Station and Jail. It was brought out at once that it
<br />had been discovered that the rear wall of the building in reaT of the City Hall
<br />was cracked and unsound. In view of this fact the Council on motion by Mr.
<br />Hillburn, seconded by Mr. Davis, voted unanimously to abandon the project at
<br />that loci!tion, and return all bids unopened.

<br />Next, Mr. John J. Stokes, appeared before the Council in the capacity of
<br />Chairman of the San MaTcos Builders and Developers. He protested the lack of
<br />consideration the Council had given to the matter of a new Subdivision Ordinance
<br />proposed by his organization. He was told the matter was still under study, and
<br />Mr. BeeCToft remarked that he for one was unalteTably opposed to Tefunds by the
<br />City fOT utilities installed by subdivideTs OT developers. Mr. Stokes said that
<br />fOT one thing the proposed ordinance made everything clear, whereas at present
<br />much is not undeTstandable, in connection with subdividing. At the suggestion
<br />of Mr. Beecroft the matter was by mutual consent laid on the table until an
<br />appropriate meeting, when MT. Stokes would be notified to attend and Mr. Terry
<br />Jacks, repTesenting the City legally in this matter, would be called to be
<br />pres ent.

<br />FiTe Chief Lewis Haynes appeared before the Council with Mr. Simms of the
<br />Simms Fire Equipment Company, which is supplying the City with equipment, for
<br />the new fire stations. Chief Haynes reported that delivery of the equipment
<br />was complete and wholly satisfactory, and he suggested acceptance formally.
<br />By mutual consent this action was defeTred to the October 17th meeting, in
<br />ordeT to peTfect all fOTmal papers etc., for payment fOT equipment.
<br />
<br />The next matter brought up was consideration of bids on supplying or
<br />wTiting insurance coveTing Volunte~r Firemen of San Marcos. Mr. KOTff moved,
<br />afteT the Council had gone over the bids, that the Maryland Casualty Company
<br />be awarded this insuTance for the ensuing three-year peTiod. MT. HillbuTn
<br />seconded the motion which, put to a vote, was carried unanimously.

<br />The Council noxt took up the matteT of the offer of the W. fl. Nagel Coat
<br />fkngeT Factory to donate the necessaTY strip off that property to comply with
<br />the requiTements of the new Highway 81 right-of-way. This offer of donation
<br />carried the provision that in return the City would install a six-inch water line
<br />to the W. H. Nagel pro peTty line. After discussion it became apparent that the
<br />laying of this line would be a good investment, inasmuch as it would actually
<br />cost less than buying the strip off the Nagel property, and would place wateT at
<br />this locality fOT future possible development. A motion was made by Mr. KOTff to
<br />accept the offer and pToposal of MT. W. H. Nagel, that the strip of land for
<br />the Highway 81 right-of-way be donated to the City, and that the City in return
<br />lay a six-inch wateT line to the Nagel pToperty; a fire plug to be installed at
<br />the end of said line; and the entire transaction and project to be fully completed
<br />before ApTil 1st, 1957. MT. Hillburn seconded the motion, and on being put to a
<br />vote it was unanimously adopted.

<br />MT. L. O. Backus then Ci!me before the Council and complained that the taxes
<br />on his property in Block 13, part of lot 2, San Marcos addition, weTe listed as
<br />on a valuation of $5,000.00, whereas when he appeared before the Equalization Board,
<br />members Schofield and Wade being present, according to MT. Backus, they agreed to
<br />set his valuation at $3,300.00, but that this obviously was not done. It was ex-
<br />plained to Mr. Backus that the Council was powerless to act, unless he obtained a
<br />letter from two members of the Equalization Board, affirming the erTor, and asking
<br />its correction.
