--I I J -...8 13: ~ ~ Q :!: Q ! ! Q ~, WHEREAS, the Board of Aldermen of the City of San Marcos has found that public necessity requires the widening of Texas-U. S. Highway No. 81 through the City of San Marcos, in Hays County, Texas; and, WHEREAS, the Board of Aldermen has found and determined that the hereinafter described land is suitable for such purpose and that it is necessary to acquire said land for such street, highway, and freeway purposes; and, WHEREAS, the City of San Marcos has negotiated with Mrs. Virginia D. Cox and her husband, John T. Cox, as the owners of such land and has been unable to agree with such owners as to the fair cash market value thereof, Now, Therefore, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF SAN ~IARCOS: That Ernest Morgan and Tom G. Oliver, Jr., be, and they are hereby employed as attorneys at law to represent the City of San Marcos in said behalf, and that they be and are hereby authorized, empowered and directed to file against all owners and lienholders, a suit in eminent domain to acquire the fee simple title for said purposes to the following described tract of land: Field notes of a sUrvey of 0.148 acre of land, being the Southeast portion of Lots Nos. One (1), Two (2) and Three (3) of the John T. Cox Subdivision, a Subdivision of record in Volume 153, page 260, Hays County Deed Records, said John T. Cox SubdiVision being a resubdivision of the Southeast one-half (1/2) of Lot No. Fifteen (15) of the A, F. Weatherford Subdivision, as conveyed in a deed from A. F, Weatherford and wife, Mrs. Dorothy Weatherford, to Mrs. Virginia D. Cox and recorded in Volume 134, page 106, Hays County Deed Records, as prepared by Hall &; Scott, Land Surveyors, San Marcos, Texas:
