<br />28 <br />.s- <br /> <br />Regular Meeting January 23, 1957 <br /> <br />On this, the 23rd day of January 1957, at 2:00 P. M. the city Council of <br />the City of San Marcos, Texas, met in a regular meeting at the City Hall in <br />San Marcos, with the following members present and participating, <br /> <br />I <br /> <br />C. M. Allen, Acting Mayor <br />S. R. Beecroft, Alderman <br />Herman Korff, Alderman <br />W. M. Davis, Alderman <br /> <br />Others present were: <br /> <br />Terry Jacks, John J. Stokes, Walter Feltner, Paul <br />Rogers, Zeb Fitzgerald, W. G. Barbee, and Fredericka Hopkins. <br /> <br />A quorum being present the meeting was called to order by Mayor C. M. Allen <br />and the following transpired: <br /> <br />I <br /> <br />Four members representing the San Marcos Developers met with the City <br />Council to discuss the provisions of the proposed San Marcos Subdivision Ordinance. <br />The.City Council at a previous meeting had, in considering the proposed ordinance <br />cut down from 90 per cent to 50 per cent the reimbursement to subdividers for <br />otilities installed by them; and changed the repayment period from 20 years to <br />10 years. After a lengthy discussion of this change in the proposed Ordinance, <br />with both sides stating their position, Mr. Allen asked Mr. Stokes what would <br />be the very best proposition he could make for the Developers, that would help <br />solve the problem, and be advantageous to both the Developers and the City. <br />Mr. Stokes then made this proposition: That subdividers be reimbursed to the <br />extent of eighty (SO) per cent of the cost of utilities installed by them. <br />If both sewer and water systems have been installed by a subdivider, the City <br />shall pay to the subdivider a sum equal to seventy-five (75) per cent of the <br />net amount of the revenue realized from the sales and service of the water <br />and sewer system so installed by a subdivider for a period of twenty (20) years; <br />and if only either a water or a sewer system alone is installed by a subdivider, <br />the City shall pay the subdivider a sum equal to f~rty (40) per cent of the <br />net amount of income realized from the sale and service of said system so <br />installed, also for a period of twenty (20) years. <br /> <br />Mr. Korff then made a motion to accept Mr. Stokes' PFoPosition. Mr. Davis <br />seconded the motion. A vote was taken which resulted as follows: <br /> <br />Korff yes <br />Davis yes <br />Beecroft no <br /> <br />The motion was carried. <br /> <br />Mr. Terry Jacks was then instructed to put the ordinance in final form <br />and present to the Council for final action. <br /> <br />Mr. Ed Williams, principal of the James Bowie Elementary School then came <br />before the Council with two suggestions he wished the Council could and would <br />enforce. They were (1), strengthen the building code by setting a certain height <br />and distance from a corner that hedge can be planted at street corner intersections; <br />(2), strengthen the building code by prohibiting any person or persons from <br />living in what are commonly called "chicken coops". <br /> <br />I <br /> <br />The Council said that they would look into the matter, instructing the City <br />Building Inspector, the City Sanitarian, and the City Attorney, to see what <br />stand the City could take in the matter. <br /> <br />Action on an Ordinance, authorizing the issuance of City of San Marcos Refunding <br />Bonds in the maximum amount of $85,000.00, for the purpose of canceling, refunding <br />and in lieu of a like amount of City of San Marcos Fire Station and Equipment <br />Warrants dated August 15, 1955, which was set for this date, and duly and legally <br />advertised, was deferred to a later date by unanimous vote of the Council. <br /> <br />Next on the agenda was a motion by Mr. Beecroft to adopt an ordinance duly <br />submitted, providing for the construction and maintenance, (note: by the State) <br />"of the portion of U. S. Highway 81 in the City of San Marcos, for the expanded <br />U. S. Highway 81 Right-of-Way by the State Highway Department. Mr. Korff seconded <br />the motion. A vote was taken which resulted unanimously in favor of the motion, <br />
