<br />. <br /> <br />-'I <br /> <br />I <br /> <br />The purpose of this ordinance is to provide for extensions <br /> <br />of utility mains for persons, firms, or corporations desiring such <br /> <br /> <br />extensions and to further provide for the reimbursement of cost of <br /> <br /> <br />such extensions for construction of same. nothing here contained <br /> <br />shall be interpreted as restricting or preventing the City Engineer <br /> <br />or Superintendent of Utilities from making needed repairs to the <br /> <br />utility system maintained by the City of San Marcos, <br /> <br />ARTICLE VIII AVAILABILITY OF FUNDS OR MATERIALS <br /> <br />In no event may the City of San Marcos be required to make <br /> <br /> <br />extensions in accordance with the provisions of this ordinance if <br /> <br /> <br />there are no funds or materials available for that purpose. <br /> <br />ARTILCE IX. REPEALING CLAUSE <br /> <br />All ordinance or parts of ordinances inconsistent with the <br /> <br /> <br />terms of this ordinance are hereby repealed; provided, however, <br /> <br /> <br />that such repeal shall be only to the extent of such inconsistency <br /> <br /> <br />and in all other respects this ordinance shall be cumulative of <br />other oridnances regulating and governing'the subject matters <br /> <br />covered by this ordinance. <br /> <br />ARTICLE X. SAVINGS CLAUSE <br /> <br />If any proviSion, exception, section, subsection, paragraph, <br /> <br /> <br />sentence, clause, or phrase of this ordinance or the application of <br /> <br /> <br />same to any person or set of circumstances shall for any reason be <br /> <br /> <br />held unconstitutional, void, or invalid, such invalidity shall not <br /> <br /> <br />effect the validity of the remaining provisions of this ordinance or <br /> <br /> <br />their application to other persons, firms, or corporations or sets <br /> <br /> <br />of circumstances and to this end, all provisions of this ordinanc~ <br /> <br /> <br />are declared to be severable. <br /> <br />26. <br />
