<br />I <br /> <br />t <br /> <br />I <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY <br />OF THE CITY OF SAN MARCOS: <br />Section 1: Section 2 of said ordinance previOusly <br />adopted by the governing body of the City of San Marcos shall be, <br />and the same is hereby, amended to read as follows: <br />"Section 2. <br />(a) It shall hereafter be unlawful to hold or <br />conduct any public dance or public ball within the limits of the <br />City of San Marcos unless and until the operator of such publiC <br />dance has obtained a license therefor. <br />(b) When any person, firm, club, or association <br />of any kind desires to hold a public dance, such person, firm, club, <br />or association shall make application to the Chief of Police <br />of the City of San Marcos for a permit to hold and conduct such <br />public dance. Such application shall contain such information <br />as may be required by the Chief of Po lice. Prior to approva 1 <br />of such application the Chief of police shall make a determination <br />as to whether or not the publiC peace and welfare will require <br />the assignment and attendance of peace officers at said dance, <br />and the number of peace officers that will be required in order <br />to maintain and preserve the peace at said dance. The person <br />making said application shall, prior to approva 1 of the peI'li1i t, <br />pay to the City of San Marcos the sum of Five Dollars ($5.00). for <br />said permit, if granted, together with an additional sum equal <br />to Ten Dollars ($10.00) for each peace officerwhowl11 be <br />assigned by the Chief of Police to preserve the peace at said <br />dance. <br /> <br />(c) Prior to the scheduled time for said dance, <br />the Chief of Police shall assign to said dance the number of <br />police personnel necessary in his judgment to preserve and main~ <br />tain the peace at said dance and shall require the service of said <br />
