<br />l2"~A <br /> <br />TERRY L. uACKS <br />ATTORNEY AT LAW <br />SAN MARCOs,TEXAS <br /> <br />April 22, 1958 <br /> <br />The City Council <br />San Marcos, Texas <br /> <br />I <br /> <br />Gentlemen: <br /> <br />Miss Elizabeth Huffmeyer and Walter Huffmeyer <br />have acquired title to and are the owners of all the lots <br />in the addition known as "Zack Williamson Addition to San <br />Marcos, Texas", which map or plat and deed of dedication, <br />dated August 22, 1908, is recorded in Volume 53 at page 392- <br />393 of the Deed Records of Hays County, Texas. The addition <br />is outside of but within three miles of the corporate limits <br />of the City of San Marcos. <br /> <br />The dimensions of the lots are 35 feet wide and <br />50 feet deep and the streets are 30 feet wide. A copy of <br />the map or plat is attached for your information. <br /> <br />I <br /> <br />It is my understanding that the lots were never' <br />occupied as lots and the str'eets were never used or maintained <br />but have been held under fence for many years by Elizabeth <br />HUffmeyer and Walter HUffmeyer. A judgment establishing title <br />in Elizabeth Huffmeyer and Walter HUffmeyer has been entered <br />by the 155th Judicial District Court of Ha;:ls County, Texas, and <br />a copy of that judgment is attached. Also, all taxes on the <br />property have been paid as evidenced by tax certificates at- <br />tached hereto. <br /> <br />It is the desire of the owners of the property to <br />vacate the plat or plan as provided by Article 973a, Sec. 5, <br />RCS. The instrument vacating such Plat or plan is attached <br />for your consideration. If you need further information or <br />desire a personal appearance before your body, please let me <br />know. <br /> <br />If you can approve the vacation of such plat I be- <br />lieve that it will relieve the city of San Marcos of an un- <br />desirable addition and will be appreciated by me and the <br />owners of the property. <br /> <br /> <br />.. <br />
