<br />~~ <br />ADJOURNED rEElING HEW ON DECE!~BE't 22, 1958 <br /> <br />2ng <br /> <br />On the 22nd day of December, 1958, the Governing Body af the City of San <br />Marcos met in adjourned session at 7:00 o'clock P.M., Mayor C. M. Allen presiding. <br /> <br />Present wore: <br /> <br />Mayor <br />Aldermen <br /> <br />C. M. Allen <br />S. ft. Beecroft <br />W. M. Davis <br />B. D. Hi llburn <br />Herman Korff <br />H. W. Steakley <br /> <br />I <br /> <br />City Manager B. R. Fuller <br />News Heporter Lee Harr <br />James Tuttle <br /> <br />The meeting was called to order by Mayor Allen. My. Tuttle was granted <br />permission to present his request that an al"ea in Highland Terrace be armexed to <br />the City. After a discussion on the request, Alderman Steakley made a motion, <br />seconded by A ldsrman Hillbur"n, that the area be accepted into the City upon <br />completion or the necessary requirement and approval by the City Attorney. Upon <br />roll call the ayes and nays. were as follows: <br /> <br />Ayes: <br /> <br />Aldermen Beecroft <br />Davis <br />Hi llburn <br />Korff <br />Steakley <br /> <br />Nayes: None <br /> <br />Mayor Allen declared the motion oassed and reQuested flllr. Tuttle to contact the <br />Ci ty Attorney for preparation of'the petition "and other requirements 'J'Jhich ';~ill <br />have to be fulfilled. <br /> <br />I <br /> <br />The members of the Governing Body reviewed the bids WOlcn had been re- <br />ceived on the Lift Station Improvements_ All the bids were carefully studied. <br />The Mayor reques~ed the City Manager to give an opinion a:..~ to the award and more <br />especially if th~ informality in the OU Plumbing Company bid constituted suffi- <br />cient reason for disqualification. City Manager Fuller reported that, in his <br />opinion, there were two items to be considercdt <br /> <br />1. SUbmission of a bid bond instead of a Cashiers Check as <br />reqLi:rscJ in the ~oltce to Bidders. It appeared to be <br />within the power of the City Council to waive this in- <br />formality as the ~ity had reserved this right in the <br />bid advertisement and instructions, whQn it is to the <br />best interest of the City to do so, and; <br /> <br />2. Failure on the part of the bidder to state the completion <br />time in working days in his bid proposal. It would appear <br />that the actual stating of a specifj.c completion time could <br />be determined as unnecessary when the Special Conditions of <br />the Specifications state IIA maximum number of one hundred <br />and twenty (120) working days is established for completion <br />of the project. In his bid, the Contractor shall estimate <br />his Gompl.etion time, if less tha.n 2bove stated.tI There <br />seems to be no burden, therefore, on the Contractor to state <br />any completion time unless it is other than one hundred <br />twenty (120) days~ <br /> <br />I <br /> <br />The City Manager told the Council thet the Engineer, Mr. Hugh Dickson, <br />had recommended award. to the lOIfJest bidder and that he, the City Manager, <br />concurred in this recommendatiorl in that he believed that the best interest of <br />the City could be served by awarding to the lowest bidder. <br /> <br />Alderman Uavis made a motion, seconded by Alderman Steakley, that the <br />low bid Df the Ot-t Plumbing Company, in the amount of Twelve Thousand Eight <br />frundred Eighcy-Four and NO/100 Dollars ($12,884.00) be accepted, pending appro- <br />val and concurrance by the State Health Deoartment and the U. S. Public Health <br />Service.
