<br />:,~iJ.~: <br /> <br />I i-Fl <br /> <br />~ <br />::0 <br />~ <br />~ <br />c <br /> <br />accepted by the County Commissioners' Court. <br /> <br />The City Manager informed the Council that two items of right-of-way <br />on R11 12 needed their attention. <br /> <br />(a) The Council had authorized payment of '200.00 to <br />Mr. ~fuitney (Lot 3 D. B. Thomas 5th) for a liveoak tree <br />if the tree died within 2 years as a result of the construc- <br />tion. Mr. I~itney requested that he be protected from any <br />liability. It was the decision of the Council that the <br />sum of $200.00 be paid and the tree removed if necessary. <br /> <br />I <br /> <br />(b) Miss Tom Collier wants the City to pay the cost of <br />moving the buildings she~ owns from the right-of-way. The <br />City Manager was authorized to contact Mr. Kohut (Miss <br />Collier's choice) and obtain a cost. It appeared to the <br />Council that Miss Collier had submitted a reasonable <br />request. <br /> <br />The matter of perpetual care at the 5an Marcos Cemetery was <br />discussed. The City Manager explained the statutes regulating cities <br />in the operation of perpetual care cemeteries and noted that San Mar- <br />cos can operate the cemetery if the Council by ordinance agrees so to <br />do~. After much discussion it WaS the unanimous decision of the Council <br />to table the matter for further study. <br /> <br />.
