I <br /> <br />~_1~'J <br />L.L~ <br /> <br />AN ORDINANCE REGULATING PARKING OF VEHICLES <br />ON CERTAIN PORTIONS OF NORTH COMANCHE. STREET; <br />REPEALING ORDINANCES IN CONFLICT; CONTAINING <br />A SEVERABILITY PROVISION; PROVIDING A PENALTY <br />FOR VIOLATION; AND, FIXING AN EFFECTIVE DATE <br />HEREOF <br /> <br />WHEREAS, it has been brought to the attention of the <br /> <br />Governing Body of the City of San Marcos that North Comanche <br />Street is not of sufficient width to permit the free passage of <br />two-way traffic and accommodate parking on both sides thereof; <br /> <br />and <br /> <br />WHERR~S, the best interest of the public requires that <br /> <br />parking on the above mentioned street must be controlled and <br /> <br />regulated. <br /> <br />NOW, THEREF'ORE, BE IT ORDAINED BY THE GOVERNING BODY OF' <br />THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section 1. It shall hereafter be unlawful to park any <br />vehicle on the East side of North Comanche Street between <br /> <br />Hopkins Street and Hutchison Street. <br />Section 2. All ordinances and/or part of ordinances in <br /> <br />conflict herewith are hereby repealed. <br /> <br />Section 3. In the event any word, phrase, clause, sen- <br /> <br />tence, paragraph or any other portion of this ordinance shall <br /> <br />be judicially determined to be unconstitutional, ineffective <br />or unlawful, such judicial holding shall not effect the <br /> <br />remaining portion hereof. <br /> <br />Section 4. Any person found guilty of violating this <br /> <br />ordinance, or any part thereof, shall be guilty of a misde- <br /> <br />meanor, and, upon conviction, shall be fined in any amount not <br /> <br />exceeding Two Hundred Dollars ($200.). <br />Section 5. This ordinance shall take effect from and after <br /> <br />its publication in a newspaper published within the City of <br /> <br />San Marcos, Texas. <br />
