44 <br /> <br />Regular Meeting <br /> <br />May 11, 1981 <br /> <br />Page 5 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />~RCOS, TEXAS AMENDING SECTIONS 18-7 AND 18-8 OF THE <br />CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS <br />TO INCREASE FEES FOR USE OF PARK AND RECREATIONAL FA- <br />CILITIES; TO ESTABLISH A REQUIREMENT FOR A DEPOSIT FOR <br />USE OF CERTAIN CITY FACILITIES; TO INCREASE THE REQUIRED <br />DEPOSIT FOR USE OF CERTAIN FACILITIES; REPEALING SECTION <br />18-9 OF SAID CODE AND ESTABLISHING AN EFEECTIVE DATE. <br /> <br />After much discussion regarding the fees to be charged in connection <br />with the Dunbar Recreation Center, Mr. Brown moved that the Ordinance <br />be approved on second reading with the exception that the Ordinance <br />be amended under Section 18-7 (1) (a) Charles $. Cock Home, to change <br />the time "Afternoon only" to 12:00 p.m.-5:00 p.m. and Mrs. Norris <br />seconded the motion, which passed unanimously. Mr. Yarbrough was <br />instructed by the Council to do a further report on charges to be <br />assessed for the use of the Dunbar Recreation Center. <br /> <br />Mr. James introduced for consideration on third and final reading an <br />Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />~LARCOS, TEXAS A~ENDING SECTIONS 2-27, 2-28, AND 2-29 <br />OF THE CODE OF ORDINANCES, CITY OF SAN MARCOS, TEXAS, <br />BY SPECIFYING WHAT CONSTITUTES THE UNCLASSIFIED AND <br />CLASSIFIED POSITIONS OF EMPLOYMENT IN SAID CITY SER- <br />VICE; BY CHANGING THE METHOD OF APPOINTING THE PER- <br />SONNEL APPEALS BOARD; BY LIMITING THE TIMES WHEN THE <br />CITY ATTORNEY WILL APPEAR AT HEARINGS ON THE CITY'S <br />BEHALF AND DECLARING AN EFFECTIVE DATE. <br /> <br />After much discussion the Ordinance was tabled to be read on third <br />and final reading at the May 18, 1981 Council Meeting. <br /> <br />Mr. James introduced for consideration a public hearing on an Ordin- <br />ance on first reading, which was read in its entirety, having the <br />following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />~.~RCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br />29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 10.95 <br />ACRES OUT OF THE T. J. CHAMBERS SURVEY, ABSTRACT NO. <br />TWO, HAYS COUNTY, TEXAS, A/K/A 1410 N. LBJ, FROM <br />"R-i" (SINGLE F~4ILY DWELLING DISTRICT) TO "D" (MUL- <br />TI-F~dILY DWELLING DISTRICT). <br /> <br />Mr. James opened the public hearing. Mr. Kenneth Sutton, represent- <br />ing Mrs. James L. Moore, spoke in favor of the zoning change. Mrs. <br />John Dunn and Mrs. Inez Ramsay, who live on neighboring property <br />to Mrs. Moore's property spoke in opposition to the zoning change, <br />as well as Mr. Robert Heffner, representing the Holland Neighbor- <br />hood Association, and Mr. Terry Lighthouse. The public hearing <br />was then closed. Mrs. Norris moved to approve the Ordinance to <br />place it on the table for discussion and Mr. James seconded the <br />motion. Mrs. Norris then stated for the reasons set out in the <br />Staff report, she would have to deny approval of the Ordinance, <br />and stated that also the Master Plan had set the boundary for <br />Multi-Family housing not to go beyond Holland Street. On roll <br />call the Ordinance failed to pass by a unanimous vote of Council. <br /> <br />Mr. James introduced for consideration a public hearing on a pro- <br />posed annexation of 7 acres out of the J. M. Veramendi League No. <br />Two, also known as Moss Cliff Restaurant, owned by Walt Schmelte- <br />kopf. Mr. James opened the public hearing. Mr. Kenneth Sutton, <br /> <br /> <br />
