<br />1- 'j-- f?, <br /> <br />5~ <br /> <br />RES 0 L UTI 0 N <br /> <br />nHEREAS, the City of San Marcos has just been advised of the <br /> <br />Administration's policy regarding drainage through urban sections of <br /> <br />I <br /> <br />interstate highways; and, <br /> <br />WHEREAS, the City has been further advised that it will have <br /> <br />the responsibility of participating in drainage improvements through <br /> <br />San Marcos in an estimated amount of $35,400.; and, <br /> <br />WHEREAS, San Marcos, a small city operating under a limited <br /> <br />budget, has the additional requirement of providing a portion of the <br /> <br />funds required to move City owned utilities from the right-of-way <br /> <br />required for the interstate construction; and, <br /> <br />WHEREAS, the Governing Body of the City of San Marcos has <br /> <br />determined that it is financially unable to provide the requested sum <br /> <br />of $35,400. required for drainage. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the <br /> <br />City of San Marcos that the State Highway Department be advised of the <br /> <br />I <br /> <br />City's financial inability to provide any portion of the sum requested. <br /> <br />BE IT FURTHER RESOLVED that the State Highway Department be <br /> <br />requested to construct that portion of Interstate 35, identified as <br /> <br />135-3(26)204, through San Marcos in accordance with the plans made <br /> <br />public and presented arid explained at a public hearing at which time <br /> <br />the City was not advised it would be requested to provide funds for <br /> <br />drainage easements, conduits, pipes or structures of any nature for <br /> <br />the conveyance of storm or surface waters regardless of their origin. <br /> <br />PASSED AND APPROVED this 3rd day of October, A.
