<br /> <br />Sf <br /> <br />~. <br />~ <br /> <br />/ <br /> <br />AN ORDINANCE REGULATING THE CON- <br />STRUCTION OF FALLOUT SHELTERS <br /> <br />I <br /> <br />BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SAN <br />MARCOS that due to the specialized purpose and emergency nature for <br />which fallout Shelters, including family fallout shelters are de-- <br />signed, any such shelter Which complies with paragraphs 1, 2, and <br />3 hereinafter quoted in this ordinance is exempt from the provi- <br />sions of the Building Code of the City of San Marcos, Texas, as <br />adopted in VOlume,S Page '/~ with amendments thereto, except as <br />otherwise provide herein. <br /> <br />1. DEFINITION. A fallout shelter, including a family <br />fallout shelter, is a structure designed, altered or constructed in <br />accordance with this Ordinance, for emergency use, to provide and <br />afford ,:>rotection from nuclear radiation, commonly known as "fall- <br />out", resulting from a neuclear incident which recently has been, <br />or is, or is likely to be of catastrophic proportions. <br /> <br />2. DESIGN. A fallout shelter, or family fallout shelter <br />shall be of a design conforming to that recommended or accepted by <br />the Federal Department of Defense, Office of Civil Defense. <br /> <br />3. CONFORMANCE. A fallout shelter, or family fallout <br />shelter, shall, in all matters relating to construction and structual <br />stability, comply with not less than the equivalent of the provi- <br />sions relating to Design Loads and General Building Requirements <br />specifies in the National Building Code (1955 Edition). <br /> <br />I <br /> <br />4. REQUIREME~7S. Notwithstanding the foregoing, the pro- <br />visions contained in Sections 102, 104, 105, and 106 of the Building <br />Code of the City of San Marcos, Texas relating to Administration, <br />?ermits, Inspections and Penalties shall be applicable to shelters <br />and family fallout shelters. <br /> <br />5. EFFECTIVE DATE. This ordinance shall be in effect on <br />and after January 1, 1962 or its date of legal publication. <br /> <br />6. VIOLATIONS. Any person, firm or corporation violating <br />the provisions of this ordinance shall be deemed guilty of a mis- <br />demeanor and upon conviction thereof shall be fined in any sum not <br />to exceed Two Hundred Dollars ($200.00). <br /> <br />PASSED, APPROVED, AND ADOPTED this the l~th day of <br />Decembe~ AD, 1961. <br /> <br />,,./-::-"',... ~ I ' <br />. :../'".(\ /,f ',!... / <br />. . _ ( r; ,.'
