AN ORDINANCE AN ORDINANCE AMENDING ARTICLE V, SECTION 8 (a), ADDING SECTIONS 9 (a), {b1, {c) and (d ), PRES- CRIBING AN EFFECTIVE DATE FOR SAID AMENDMENT' TO AN ORDINANCE ENTITLED "AN ORDINANCE PRESCRIBING REGULATIONS FOR ALL RESTURANTS IN THE CITY OF SAN MARCOS; DEFINING CERTAIN 'NORDS AhID PHRASES USED IN THIS ' ORDINANCE; PROVIDING FOR ISSUANCE BY THE CITY HEALTH OFFICER OF PERMITS FOR OPERATION OF RESTURANIS AND PRESCRIBING FEES FOR SUCH PER- MITS; AUTHORIZING THE HEALTH OFFICER TO MAKE INSPECTIONS OF RESTURANIS AND PRESCRIBING SANI- TATION REQUIREMENTS FOR ALL RESTURANTS; PRESCRIB- ING CERTAIN REGULATIONS FOR THE CONTROL OF COMMUNI- CABLE DISEASES; ADOPTING INTERPRETATIONS OF THE UNITED STATES PUBLIC HEALTH SERVICE CODE REGULATING EATING AND DRINKING ESTABLISHMENTS AS FILED WITH THE CITY CLERK; PRESCRIBING PENALTIES FOR VIOLATIONS OF PRDVISIONS OF THIS ORDINANCE: REPEALING ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVING CLAUSE; AND DECLARING AN EMERGENCY.", AS ADOPTED BY THE GOVERNING BODY OF THE CITY OF SAN MARCOS ON OCTOBER 2, 1951 ON PAGE 164 , VOLUME 13 OF THE MINUTES OF SAID GOVERNING BODY. WHEREAS, it is found necessary and expedient by the Governing Body of the City of San Marcos, Texas, in order to promote the public health and prevent the spread of disease to amend the captioned ordinance. NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of San Marcos, Texas, that: ~~~ ' SECTION 1.ARTICLE V, SECTION 8 (a) of the referenced ordinance is herehy amended to read as follows; "SECTION. 8 (a) It shall be unlawful for any person, firm, partnership or corporation to accept any person for employment in any food establishment, as that term is herein defined in this ordinance, unless such person shall have obtained a valid Health Certificate as provided herein, For the purpose of this ordinance "food establishment", in addit- ion to other items enumerated elsewhere herein, shall include any hotel dining room, cafe, resturant, grocery store, fruit stand (itinerant or otherwise), drug store soda fountain, bakery, meat market, or any establishment preparing, selling, serving or exposing for sale any food, food product and~or drink product or products intended for human consumption". SECTION 2. The provisions of SECTION 9 of the captioned ordin- ance shall be deleted and the following substituted therefor: "SECTION 9 (a) Any person required 6y this ordinance to have a Health Certificate must obtain a current Tuberculin Skin Test and~or chest x-ray. If the Tuberculin Skin Test is positive it must be followed by a chest x-ray before a Health Certificate may 6e issued. The Tuberculin Skin Test may be obtained from any private ' physician, licensed to practice in Texas, or from the San Marcos Health Department. Chest x-rays, if required, may be ohtained from any physician licensed to practice in Texas, any hospital licensed to operate in Texas, or from the San Marcos Health Department. Chect x-rays, if required, may be ohtained from any physician licensed to practice in Texas, any hospital licensed to operate in Texas or any source approved by the Hays County Medical Association. The chest x-ray film or plate must be held by the person or agency taking the x-ray for a period of six months and be available for examination by the City Health Officer or his authorized represenative. 5 t ~.
