<br />AN ORDINANCE <br />AN ORDINANCE AMENDING ARTICLE V, SECTION 8 (a), <br />ADDING SECTIONS 9 (a), {b1, {c) and (d ), PRES- <br />CRIBING AN EFFECTIVE DATE FOR SAID AMENDMENT' TO <br />AN ORDINANCE ENTITLED "AN ORDINANCE PRESCRIBING <br />REGULATIONS FOR ALL RESTURANTS IN THE CITY OF SAN MARCOS; <br />DEFINING CERTAIN 'NORDS AhID PHRASES USED IN THIS <br />' ORDINANCE; PROVIDING FOR ISSUANCE BY THE CITY <br />HEALTH OFFICER OF PERMITS FOR OPERATION OF <br />RESTURANIS AND PRESCRIBING FEES FOR SUCH PER- <br />MITS; AUTHORIZING THE HEALTH OFFICER TO MAKE <br />INSPECTIONS OF RESTURANIS AND PRESCRIBING SANI- <br />TATION REQUIREMENTS FOR ALL RESTURANTS; PRESCRIB- <br />ING CERTAIN REGULATIONS FOR THE CONTROL OF COMMUNI- <br />CABLE DISEASES; ADOPTING INTERPRETATIONS OF THE <br />UNITED STATES PUBLIC HEALTH SERVICE CODE REGULATING <br />EATING AND DRINKING ESTABLISHMENTS AS FILED WITH THE <br />CITY CLERK; PRESCRIBING PENALTIES FOR VIOLATIONS OF <br />PRDVISIONS OF THIS ORDINANCE: REPEALING ORDINANCES <br />OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING <br />A SAVING CLAUSE; AND DECLARING AN EMERGENCY.", AS <br />ADOPTED BY THE GOVERNING BODY OF THE CITY OF SAN MARCOS <br />ON OCTOBER 2, 1951 ON PAGE 164 , VOLUME 13 OF THE MINUTES <br />OF SAID GOVERNING BODY. <br />WHEREAS, it is found necessary and expedient by the Governing <br />Body of the City of San Marcos, Texas, in order to promote the public <br />health and prevent the spread of disease to amend the captioned ordinance. <br />NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City <br />of San Marcos, Texas, that: <br />~~~ <br />' SECTION 1.ARTICLE V, SECTION 8 (a) of the referenced ordinance <br />is herehy amended to read as follows; <br />"SECTION. 8 (a) It shall be unlawful for any person, <br />firm, partnership or corporation to accept any person for <br />employment in any food establishment, as that term is herein <br />defined in this ordinance, unless such person shall have <br />obtained a valid Health Certificate as provided herein, For <br />the purpose of this ordinance "food establishment", in addit- <br />ion to other items enumerated elsewhere herein, shall include <br />any hotel dining room, cafe, resturant, grocery store, fruit <br />stand (itinerant or otherwise), drug store soda fountain, <br />bakery, meat market, or any establishment preparing, selling, <br />serving or exposing for sale any food, food product and~or <br />drink product or products intended for human consumption". <br />SECTION 2. The provisions of SECTION 9 of the captioned ordin- <br />ance shall be deleted and the following substituted therefor: <br />"SECTION 9 (a) Any person required 6y this ordinance to <br />have a Health Certificate must obtain a current Tuberculin <br />Skin Test and~or chest x-ray. If the Tuberculin Skin <br />Test is positive it must be followed by a chest x-ray <br />before a Health Certificate may 6e issued. The <br />Tuberculin Skin Test may be obtained from any private <br />' physician, licensed to practice in Texas, or from the <br />San Marcos Health Department. Chest x-rays, if <br />required, may be ohtained from any physician licensed <br />to practice in Texas, any hospital licensed to <br />operate in Texas, or from the San Marcos Health Department. <br />Chect x-rays, if required, may be ohtained from any physician <br />licensed to practice in Texas, any hospital licensed to <br />operate in Texas or any source approved by the Hays <br />County Medical Association. The chest x-ray film <br />or plate must be held by the person or agency taking <br />the x-ray for a period of six months and be available <br />for examination by the City Health Officer or his <br />authorized represenative. <br />5 t ~. <br />
