"j: .,'" c, ~ './ ..m {C/h ~~, RESOLUTION 'I WHEREAS, the State Bank and .Trust Company of s~nijarcos' has in its custody a trust fund established to care for the grave spaces of the Mead and Collins famUjes in the San Ma:rcos r::;emetery; and", WHEREAS,the'!-erms and conditions of the l"rustrest:rictthe said State Bank and Trust Coinpany in the mannex in which it may use the proceeds which accrue therefrom and stipulate the way in which the monies may be spent; and, I '. WHEREAS, it is the desire of the state Bank and Trust Company to transfer to the San Marcos cemetery Perpetual Care Maintenance Fund such monies as may be legally transferred thereto for the care of graves enemerated herein- after and covered by said Trust. NOW, THEREFORE, BE IT RESOLVED, that the Governing BOdy of the City of San Marcos accepts the funds in trust as though they were a part of the City of San Marcos Perpetual Care Trust Fund and in accordance with the terms of the said Trust accepts. the following graves under the City's Perpetual Care Plan; viz, Old Original, Section K, Block 19, lots 1-4; all Original, Section F, Block 27, Lots l-B; and, Rose Lawn, Section .A, Block 53, Lot 4. BE IT ALSO RESOLVED that the State Bank a~dTrust'CompanYHshall, in accordance with the said trust, contribute Twenty-Five cents (25~) to the City of San Marcos for general cemetery maintenance ~r each One Dollar ($1.00) spent in perpetual care. .BE IT FU!l-rHER RESOLVED that the stateJ;lank and rrustCOIlIpany is permitted to retain the normal charges for maintaining and handling such a trust fund, said charges to be in accordance with the laws of the state of Texas regulating such matters.
