<br />1-Jlc: <br /> <br />~1 <br /> <br />AN ORDINANCE AUTHORIZING POLICE OFFICERS <br />OF THE CITY OF SAN MARCOS, TEXAS, TO ARREST <br />WITHOUT WARRANT WITHIN THE CITY LIMITS PERSONS <br />WHO ARE FOUND IN SUSPICIOUS PLACES, UNDER SUSPICIOUS <br />CIRCUMSTANCES, WHO Ti-REATEN OR ARE ABOUT TO <br />COMMIT ANY OFFENSE PROVIDING A SAVINGS CLAUSE. <br /> <br />I <br /> <br />WHEREAS, the mu nicipal authorit.ies of towns and cities have the <br />authority to establish rules authorizing arrest without a warrant of certain <br />persons under certain circumstances; and <br /> <br />WHEREAS, it is deemed in the public interest that the City of <br />San Marcos avai I i tsel f of th is authori ty. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY TrE GOVERNING <br />BODY OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Section I that; any police officer of the City of San Marcos, <br />Texas, in the exercise of sound discretion, any arrest without a warrant, <br />therefor, within the territorial limits of said city, any person or persons <br />found in suspicous places, and under circumstances which reasonably show <br />that such persons or person have been guilty of some felony or breach of <br />the peace, or threaten, or about to commit some offense against the laws. <br /> <br />I <br /> <br />Section 2 The City of San Marcos, Texas, having no ordinance <br />making provision for arrests without warrants, as authorized by Article 214 <br />of the Code of Criminol Procedure and of the State of Texas as amended, <br />and a public necessity therefore, creates an emergency requiring that this <br />ordinance shall be in full force and effect upon and after its passage and <br />legal publication. <br /> <br />Section 3 Any word, phrase, clause, sentence or section of this <br />ordinance which may be found to be "invalid or unconstitutional by a court <br />of competent jurisdiction, then it shall in no way invalidate the remainder <br />of the ordinance. <br /> <br />PASSED, APPROVED, AND ADOPTED this 9th day of October, <br />A.D., 1962. <br /> <br />- /', / <br />('" j-7" - J <br />" ~ C', c- II <br />< '-/ I \ ",({; !<fJ.~J/ <br />C.M.
