JO 1~ AN INTERIM ORDINANCE PROVIDING THAT NO BUILDING PERMIT SHALL HEllEAFTER BE ISSUED EXCEPT WITH THE APPROVAL OF THE CITY PLANNIr<<:l COMMISSION OR THE GOVERNIl'<<3 BODY OF THE CITY OF SAN MARCOS, TEXAS, OR THEIR FAILURE TO Acr THEREON I WHEREAS, it is the intention of tho Governing Body of the City of San Marcos, Texas, to do~egate to the City of San Marcos P~anning Commission the duty of making and recommending, for adoption, a mastor plan for the City, including an ardinanco for zoning the City in accordance with Article 1011a to 1011L, Rovisod Civil Statutuos of the Stato of Toxas, and future amendmonts theroto; and, WHeREAS, it is belioved that the best interests of tho citiZens of tho City will he SerVed by the enactment of an interim ordinance dosigned to protect tho property contomplated to be acquired by tho City under a genoral plan of urban devolopmont approved by tho qualified voters of the City at a Spocial election held on Soptomber 18, 1962, NOW, THtREFORE, BE IR ORDAINED BY THE GOVERNING BODY OF THE CITY OF SAN MAlICOS, TEXAS; Section 1. That horoaftor, until tho logal adoption of a comprohonsive Zoning Ordinance by tho City of San Marcos, Texas, all requests for building permits shall first bo submitted to the City Planning Commission for a report and recommondation boforo same may be grantod by tho City's Building Inspoctor. Section 2. That in case of an advorse roport and recommendation by the City Planning Commission, amounting to a rofusal to iSSUe such a permit, samo may bo ovorruled by the GOVerning Body of the City of San Marcos, Texas, by a majority vote, I Soction 3. That tho City Planning Commission shall act promptly on all such requosts for building p rmits and that in caso any such roquost is not acted upon within ton (10) days from its roceipt, thon such requost shall bo deomod to havo bean apprOVed by the City Planning Commission, and shall bo granted unleSS doniod by tho Govorning Body of tho City of San Marcos, Toxas, within that sarno poriod of timo. Soction 4. If any word, phraso, ClaUSe, sontenco or soction of this ordinanCe shall bo ooemod unconstitutional or illogal by a court of compotont jurisdict- ion,thon such shall not invalidate tho romaind"r of this ordinanco. Soction 5. This ordinanCe shall be in full forCe and offect from and aftor the date of its logal publication in a newspapor having general circulation in tho City of San Martos, Toxas.
