rr{CI-~( 91""1 I AN OllDINAN~ AMENDING ART ICLE XVI OF THE BUllDTNG CODE OF THE CITY OF SAN MARCOS, TEXAS (SAME BEING THE NATIONAL BUILDING CODE OF 1949, AS AMENDED) ADOPIED BY THE CITY OF SAN MARCOS ON JANUARY 12, 1955; ADDING A NEW SUB-SECT ION NO. 1600.4 TO SECTION 1600 "SIGNS AND OlJrDOOR DISPLAY STRUCTURE" WHEREAS, it has come to the attention of the Governing Body of tho City of San Marcos, Texas, and it is deemed in tho best intorost of tho public safoty, hoalth and general Welfare to take appropriate stops to control the erection of posts or polos designed for special lighting effects, which posts or poleS will bo on City property, NOW, THeREFORE, BE IT ORDAINED by the Govorning Body of the City of San Marcos, Texas, as follows: S~CTION 1, Article XVI of the City's Building Code (National Building Codo of 1949, as Amondod), adopted by tho City of San Marcos on January 12, 1 955, be amondod by adding a neW sub-Section to "Articlo XVI SIGNS AND OlJrDOOR DISPLAY STRUCTURl:S, SECTION 1600 GENERAL", which shall read as follows: 1600.4 POSTS OR POLl:S FOR SPECIAL LlGfITING EFFECTS Posts or poles for special lighting effect fixtureS may be placed botweon th" sidewalk and curb lino, provid"d'.that Article XVI, S..ction 1600.1 and 1600.2 of the San Marcos Building Cod" hav.. b"..n ';';";; ii;enlplied with; and subj"ct to the following limitations and r"strictions I I (a) No post or pol.. for such light shall contain or have attached to it any adVertising matter. (b) No light installed shall res"mble a traffic control dovice. (c) No post or pol" shall be largor than 3 inches in diam"tor, nor be installed nearor than 12 inches to the curb line.. (d) No post or pole shall interf..re with ingreSS or ogress, or with the free USe of sidewalks. (e) No light shall be installed that would onstitute a hazard or a nuisanCe to private or public property. (f) ~ach new t..nant or proprietor shall be required to obtain a permit for existing posts or poleS as p..rmitted previously by this ordinance. (g) No post or pole shall be installed until complete plans and specifications hav.. been submitt"d to the building inspector and an "on sit,," insp..ction hasbeon made by th" building inspector. I SeCTION 2. If any word, phrase, claUSe, sentenco or section of this ordinanCe shall be deemed unconstitutional or illegal by a court of competent juriSdiction, th"n such shall not invalidate the ramainder of this ordinanCe. SECTION 3. This ordinanc~ shall be in full forCe and effect from and aftor the dato of its legal publication in a n"wspapor having genoral circulation in the City of San Marcos, Texas. ~~
