<br />.~ _ t): 12, <br />./ " <br /> <br />~" <br />lii-( <br /> <br />RESOLUTION <br /> <br />I <br /> <br />WHEREAS, the City of San Marcos has been notified by District <br />14 of the Texas Highway Department that there exists a tract of land <br />consisting of 0.147 acres of land located on Interstate 35, specifically <br />part of Lots 78 and 79, Block 1, of the Rio Vista Terrace Subdivision; and <br /> <br />WHEREAS, it has been determined that the said tract issurplus <br />to the needs for construction purposes of Interstate 35; and, <br /> <br />WHEREAS, it is the Highway Department's policy to dispose of <br />such surplus right-of-way and return it to the tax rolls whenever possible <br />by offering it for sale first to the abutting or adjoining land owner, second <br />to the original grantors, and lastly on sealed bids to the general public; and, <br /> <br />WHEREAS, Golf Oil Corporation is the abutting property owner and <br />has expressed a desire to acquire this surplus land, <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Governing Body <br />of the City of San Marcos that the said 0.147 acres, more particularly <br />described by metes and bounds description attached as exhibit "A", is no <br />longer needed by the citizens of San Marcos as a road and is agreeable to <br />the Highway Department disposing of the land on the regular priority basis <br />as established by the Department, first priority being conveying the land to <br />the abutting land owner, Gulf Oil Corporation, pravided that his offer meets <br />the requirements of the State Highway Department. <br /> <br />I <br /> <br />PASSED AND APPROVED this 15th day of January, A.D., 1963. <br /> <br /> <br />ATTEST: <br /> <br /> <br />I <br /> <br />~~ <br />
