<br />AN ORDINANCE PROMOTING THE HEALTH AND WELFARE
<br />OF THE CITIZENS OF SAN MARCOS, TEXAS, BY MAKING
<br />IT UNLAWFUL TO ALLOW STAGNANT WATER TO ACCUMU-
<br />LATE OR REMAIN ON PREMISES: BY MAKING IN UNLAW-
<br />FUL TO ALLOW CARRION, FILTH OR OTHER IMPURE OR
<br />UNWHOLESOME MATTER TO ACCUMULATE OR REMAIN ON
<br />PREMISES; BY MAKING IT UNLAWFUL TO ALLOW WEEDS,
<br />RUBBISH, OR OTHER UNSIGHTLY, OBJECTIONABLE OR
<br />UNSANITARY MATTER TO ACCUMULATE OR GROW ON
<br />PREMISES; PROVIDING FOR NOTICE TO BE GIVEN TO OWNERS
<br />OR OCCUPANTS OF SUCH PREMISES IN CASE OF THEIR
<br />FAILURE OR REFUSAL TO SO DRAIN OR REMOVE ANY SUCH
<br />STAGNANT WATER, CARRION, FILTH, OR OTHER IMPURE
<br />OR UNWHOLESOME MAHER, OR I N CASE OF THEIR FAIL-
<br />URE OR REFUSAL TO SO CUT DOWN OR REMOVE ANY
<br />SUCH WEEDS, RUBBISH, BRUSH, OR OTHER UNSIGHTLY,
<br />OBJECTIONABLE OR UNSANITARY MATTER; PROVIDING FOR
<br />THE PERFORMANCE OF SUCH DRAINING, REMOVING OR
<br />CUTTING BY THE CITY OF SAN MARCOS IN THE EVENT
<br />OF CONTINUED FAILURE OR REFUSAL AFTER NOTICE TO
<br />OWNERS OR OCCUPANTS; PROVIDING FOR THE FIXING
<br />OF A LIEN AGAINST SUCH PREMISES FOR SUCH WORK OR
<br />IMPROVEMENTS; CONCLUDING WITH PARTIAL INVALIDITY,
<br />REPEAL OF CONFLICTING ORDINANCES AND EFFECTIVE
<br />DATE PROVISIONS.

<br />WHEREAS it is deemed by the City Council of the City of San Marcos,
<br />Texas, that the health and welfare of the public in general and that of the
<br />,citizens of Son Marcos in particular is or wilL be endangered by those premises
<br />within the City of San Marcos upon which the owners or occupants thereof
<br />allow or pemit the accumulation or growth therein or thereon of stagnant
<br />water, filth, carrion, weeds, brush, rubbish, or other impure, unsightly,
<br />unwholesome or unsanitary matter of any kind; and,
<br />
<br />WHEREAS it is expressly provided by the provisions of Article 4436,
<br />Revised Civil Statutes of Texas, that cities having a population of more than
<br />five thousand people shall have the power to correct the evi Is herei"nbefore
<br />recIted, and the City of San Marcos, Texas, is a city of more than five
<br />thousand population:

<br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the
<br />City of San Marcos, Texas, as follows:
<br />
<br />SECTION 1. It shall be unlawful for any person, firm or corporation
<br />owning or occupying any lot or lots, grounds or yards, or any other places
<br />within the City of San Marcos, Texas, to permit or allow stagnant water to
<br />accumulate or remain thereon.

<br />SECTION 2. It shall be unlawful fOr any person, firm, or corporation
<br />owning or occupying any house, building, establishment, lot or lots, grounds
<br />or yards in the City of San Marcos, Texas, to pelT1')it or allow carrion, filth,
<br />or other impure or unwholesome matter of any- kind to accumulate or remain'
<br />thereon, or from any other cause be in such condition as to be liable to
<br />produce disease.

<br />SECTION 3. It shall be unlawful for any person, firm, or corporation,
<br />owning or occupying any lot or lots, grounds or yards within the City of
<br />San Marcos, Texas, to pelll1it or allow weeds, rubbish, brush, or any and all
<br />other unsightly, objectionalbe or unsanitary matter of whatever nature to accu-
<br />mulate or grow on said lot or lots, grounds or yards.
