<br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />-:< <br />_J <br /> <br />~ <br /> <br />1-" <br />~/ <br /> <br />AN ORDINANCE AMENDING SECTION VII OF "AN ORDINANCE <br />DEFINING AND REGULATING ITINERANT MERCHANTS, ITINERANT <br />VENDORS, PEDDLERS, AND PERSONS SElliNG OR TAKING ORDERS <br />FOR GOODS, WARES, MERCHANDISE, SERVICES, PHOTOGRAPHS, <br />NEWSPAPERS, MAGAZINES OR SUBSCRIPTIONS TO NEWSPAPERS OR <br />MAGAZINES; PROVIDII\JG FOR A LICENSE AND A LICENSE FEE; <br />REQUIRING A BOND; AND PROVIDING PENALTIES FOR THE VIOlA- <br />TION OF THIS ORDINANCE, INCLUDING A FINE NOT LESS. THAN <br />$ 10 NOR MORE THAN $100." <br /> <br />WHEREAS, it has come to the attention of the Governing Body of the City <br />of San Marcos that the best interest of the citizens of San Marcos would be <br />served if Section VII of the above captioned Ordinance should be amended <br />and would provide for the protection of the health, safety and welfare of <br />the citizens of San Marcos, Texas. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City <br />of San Marcos, that said Section VII of the above captioned ordinance <br />passed and approved on the 10th day of August, 1955, be amended to <br />read as fo 1I0ws: <br /> <br />SECTION VII. The provisions of this ordinance shall not apply <br />to sales made to dealers by commercial travelers or sales agents <br />in the usual course of business, nor to sales made under outhority <br />and by order of law, nor the vendors of farm products produced <br />by the owner, on his own or rented land, and surplus to his <br />needs. This surplus may be delivered to wholesale distributors <br />of produce, licensed merchants who pucchase the produce for <br />resale, or to individuals who have specifically contractlld with <br />said farmer for the surplus farm commodities on an availability <br />basis. Dairy products consisting of unpasteurized milk, butter, or <br />milk products, or any dairy product, not bearing the inspection <br />stamp of an approved local, state, or federal inspector, shall <br />not be offered for sale within the corporate limits of the City <br />of San Marcos to any commercial establishment or individual. <br /> <br />PASSED, APPROVED, AND ADOPTED this 21st day of May, A.D., 1963. <br /> <br />J/tra~fi ~~ <br /> <br />Frank Taylor / <br />Mayor <br /> <br />ATTEST: <br /> <br /> <br />60~ <br />
