I <br /> <br />WHEREAS,il has come 10 the <br />attention of the Governing Body. <br />oUhe City of San Mareosthat Ihe <br />best interest of the citizens .of <br />San Marcos would be served if <br />Section VII of the above caption- <br />ed Ordinance should be amended <br />and would provide for the pro':' <br />tectiori of 'the health, safety and <br />welfare of the citizens of San <br />M~fCos; Texas. <br />NOW, THEREFORE, BE IT <br />ORDAINED hy - Ihe Governing <br />Body of the City of San Marcos, I <br />Ihat s.aid Section VII of the above <br />captioned ordinance passed and <br />approved on the 10th, day of Au. <br />gust, 1955, be amended to read as <br />follows: <br />SECTION VII. The provisions <br />of this ordinance shall not <br />apply to sales made. to deal- <br />e~.s by commercial travelers <br />or sales agents in the usual <br />course of ,business. nor to <br />sales m.ade under authority <br />and. by order of law, nor the <br />vendors; of- farm products <br />produced by the owner, _on <br />his own or rerit~d land, an~ <br />surplus to his needs, This <br />.urplus may_.btl .dellveredO>l <br />whoresate; '"di.tributors "of <br />p. r.Odllce. licensed._ merchants- <br />who purchase the produce for <br />resale, or to individuals who <br />have sp~cific"lly ,contracted <br />with said farri1er for the sur~ <br />phiS farm commodities on 'an <br />availability, basis.
