<br />I <br /> <br />.2- <br /> <br />ILl <br /> <br />any amendment, supplement, change, modification, or <br />repeal, the Governing Body shall: <br /> <br />A. Submit the same to the Planning and Zoning Commission <br />for their recommendation and report; and, <br /> <br />B. No regulation, restriction or boundary change shall <br />become effective until after a public hearing in relation <br />thereto, at which parties in interest a nd citizens shall <br />have an opportunity to be heard, At I east 15 days notice <br />of the time and place of such hearing shall be published <br />in an official paper, or a paper of general circulation, <br />in the City of San Marcos, Texas 0 <br /> <br />C. Unles8 such amendment, supplement, change, modifi- <br />cation or repeal has been approved by the Planning and <br />Zoning Commission, or if a protest against the same has <br />been filed with the City Secretary, duly signed and acknow- <br />ledged by the owners of 20% (twenty percent) or more, <br />either of the area of lots included in such proposed change, <br />or of those immediately adjacent in the rear thereof <br />extending 200 feet therefrom, or of those directly opposite <br />thereto extending 200 feet from the street frontage of such <br />opposite lots, such amendment shall not become effective <br />except by favorable vote of threp-fourths of all the members <br />of the legislative body of the City of San Marcos, The <br />provisions of Subsection B, above, relative to public hearing <br />and official notice shall apply equally to all changes and <br />amendments. <br /> <br />SECTION 3 OfFICIAL ZONING MAP: <br /> <br />I <br /> <br />The Official Zoning Map of the City of San Marcos shall <br />be kept in the official files of the City Secretary, Copies <br />shall be maintained in the office of the City Manager, <br />the City Planner, the official files of the Planning and <br />Zoning Commission, the Chief Inspector, the City Engineer <br />and the dfice of the Tax Assessor-CollectoL The Map <br />entitled ZONING MAP OF THE CIty OF SAN MARCOS, TEXAS, <br />shall constitute an official part of this Ordinance as herein- <br />after set out. <br /> <br />SECTION 4 DEfINItIONS: <br /> <br />I <br /> <br /> <br /> <br />for the purpose of clarification, it is the intent of this <br />Ordinance that the following words or phrases shall be <br />interpreted to have the meaning as outlined below: <br /> <br />Accessory building: In a residential district, a subordinate <br />building, attached to or detached from the main building, <br />without separate utilities, and not used for commercial purpose, <br />or rented. It may be used as servants' qUdrters, a wash- <br />room, storage room for domestic storage belonging to the <br />owner or tenant only, or a space for one or more automobiles <br />owned by the owner, tenant or guests. In districts other <br />than residential, an accessory building is a subordinate <br />building the use of which is incidental to and used 'only <br />in conjunction with the main buildingo <br /> <br />Apartment: A room in an apartment house occupied by not <br />more than two individuals; or, a suite of rooms arranged, :I" <br />designed, or occupied as a residence by a single; fa mil y'~:~i <br />individual, or groups of individuals. . l <br /> <br /> <br />j <br />
