<br />52 <br /> <br />RESOLUTION 1981-34R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, GRANTING APPROVAL FOR <br />THE CONSTRUCTION BY SOUTHWEST TEXAS STATE <br />UNIVERSITY OF A SIX-FOOT WIDE SIDEWALK ALONG <br />THE SOUTH SIDE OF SESSOM DRIVE FROM L.B.J. <br />DRIVE TO PLEASANT STREET WITHIN THE RIGHT- <br />OF-WAY OF SESSOM DRIVE, STATING THE TERMS <br />UNDER WHICH SUCH APPROVAL IS GRANTED AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, Southwest Texas State University proposes to <br />construct at its expense a six-foot wide sidewalk along the <br />south side of Sessom Drive from L.B.J. Drive to Pleasant Street; <br />and, <br /> <br />WHEREAS, said construction will occur either in or partially <br />in the right-of-way of Sessom Drive; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />believes said construction will greatly increase the safety of <br />students and other pedestrians and motorists traveling in the <br />area; and, <br /> <br />WHEREAS, Southwest Texas State University has agreed that <br />it will bear any expenses associated with relocation of utility <br />poles, should such relocation be required by the City's Engineer <br />as a result of said construction; and, <br /> <br />WHEREAS, final plans for said construction shall be submitted <br />to and approved by the City prior to the beginning of construction; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That approval for the construction of a six-foot <br />wide sidewalk along the south side of Sessom Drive, from L.B.J. <br />Drive to Pleasant Street, as illustrated on Exhibit A, and at <br />the sole expense of Southwest Texas State University, including <br />the expense of any relocation of utility poles required by the <br />City's Engineer, final plans for which construction shall have <br />been approved by the City prior to the beginning of construction, <br />is hereby granted. <br /> <br />PART 2. That this Resolution shall be in full force and <br />effect immediately upon its passage. <br /> <br />ADOPTED this <br /> <br />11th day of May, 1981.. <br /> <br />~ <br /> <br />Berry R.
