Jetty, Bob Barth and others <br /> <br />The Mayor called the meeting to order at 7:30 p.m. He announced <br />the purpose of the meeting, and said the Council was ready to begin <br />the hearing requested by former Sergeant Billy James White, following <br />his dismissal by the Chief of Police on November 20, 1963. <br /> <br />I <br /> <br />Alderman Moore moved that the hearing be held in closed session, the <br />Council, the City Manager, City Secretary, City Attorney, Police Chief <br />Dial, Mr. White and his counsel being present. He explained that his <br />motion was made on recommendation of the City Attorney. Alderman Stokes <br />seconded the motion. Alderman Ruiz said he would like to ask Mr. White <br />whether he preferred the hearing be open to the public, or held in closed <br />session, explaining he wished to defer to Mr. White's wishes in the matter. <br />Mr. Jaime Gutierrez, Mr. White's attorney, said he felt the people of <br />San Marcos were entitled to know what transpired at the hearing, and that <br />his client would like an open session. The question being called for, <br />the following vote was recorded: <br /> <br />AYE: Stokes <br />NAY: Moore, Pool, Ruiz <br /> <br />Whereupon, the Mayor declared the motion defeated. and stated the hearing <br />would be held in open session. <br /> <br />I <br /> <br />The City Attorney called to the attention of the Council the fact that <br />Mr. Gutierrez had brought a court reporter to the hearing, and advised <br />the Council to make a decision on allowing the hearing to be recorded <br />in this manner. The Mayor commented that if the reporter were allowed <br />to take down the hearing, it should be with the understanding that the <br />City receive a copy of the transcript. Alderman Stokes moved that the <br />court reporter not be allowed to take notes on the hearing. Mr. Gutierrez <br />said that serious charges had been made by both parties involved in the <br />hearing, and he wished his client to be protected by having a complete <br />record of the testimony. Alderman Moore seconded Alderman Stokes' motion, <br />and on roll call, the following vote was recorded: <br /> <br />AYE: Moore, Pool, Stokes <br />NAY: Ruiz <br /> <br />The Mayor declared the motion carried, and stated the reporter would <br />not be allowed to record the hearing. <br /> <br />Cl' <br />::c <br />;.-. <br />~ <br />'..\I <br /> <br />8EZ <br />
