<br /> <br />~ <br />" <br /> <br />AN ORDINANCE REGULATING PARKING OF VEHICLES ON <br />THE WEST SIDE OF ACADEMY STREET BETWEEN LINDSEY STREET <br />AND JAMES STREET; REPEALING ALL ORDINANCES IN CON- <br />FLICT; CONTAINING A SEVERABILITY PROVISION; PROVIDING <br />A PENALTY FOR VIOLATION; AND, FIXING AN EFFECTIVE DATE <br />HEREOF. <br /> <br />I <br /> <br />WHEREAS. it has been brought to the attention of the Governing Body <br />of the City of San Marcos that Academy Street between Lindsey Street and James <br />Street is not of sufficient width to permit free passage bf two-way traffice and <br />accomodate parking on both sides thereof; and <br /> <br />WHEREAS, the best interest of the public requires that parking on the <br />above mentioned street must be controlled and regulated. <br /> <br />NOW ,THEREFORE, BE IT ORDAINED BY THE GOV- <br />ERNING BODY OF THE CITY OF SAN MARCOS, TEXAS. <br /> <br />S e c t ion 1. It shall hereafter be unlawful to park any vehicle on <br />the West side of Academy Street between Lindsey Street and James Street. <br /> <br />S e c t ion 2. A II ordinances and/or part of ordinances in conflict <br />herewith are hereby repealed. <br /> <br />Section 3. In the event any word, phrase, clause, sentence, para- <br />graph or any other portion of this ordinance shall be judicially determined to be <br />unconstitutional, ineffective or unlawful, such iudicial holding shall not affect <br />the remaining portion hereof. <br /> <br />I <br /> <br />Section 4. Any person found guilty of violating this ordinance, or <br />any part hereof, shall be guilty of a misdemeanor, and, upon conviction shall <br />be fined in the amount not exceeding Two Hundred Dollars ($200), <br /> <br />Section 5. This ordinance shall take effect from and after its pub- <br />lication in a newspaper published within the City of San Marcos, Texas. <br /> <br />PASSED, APPROVED, AND ADOPTED this 8th day of April A.
