Walker <br /> <br />The Mayor called the special meeting to order at 3:00 p.m., April 20, 1964. <br />Councilmen signed Consent to Meeting. <br /> <br />I <br /> <br />The Mayor introduced the matter of employing counsel to represent the City <br />in Cause No. 8138, BILLY JAMES WHITE vs THE CITY OF SA1'l MARCOS, et al. <br />He reminded Councilmen that the Council had approved a Resolution April 8, 1964 <br />tc employ counsel. The City Attorney, a defendant, had been requested to <br />discuss the matter with the State Bar of Texas, and ask for recommendaticn <br />for attorneys. The firm of Clark, Thcmas, Harris, Denius and Winters of <br />Austin was recommended tc City Attorney Walker. Mr. Walker reported he had <br />contacted the firm, and the attorneys had agreed to defend the City on an <br />hourly basis of $20, plus expenses, COUrt costs, depositions, etc. Mr. Walker <br />stated this was a fair and regular cost, and expressed himself as being <br />"heartily in favor of employing this firm". <br />The Maycr said; ''The Council passed the Resolution, and if it is the pleasure <br />of this CounCil, I would entertain a motion to employ Clark, Thomas, Harris, <br />Denius and Winters ". Alderman Pool moved that the firm cf Clark, Thomas, <br />Harris, Denius and Winters be employed to defend the City of San MarcOS. <br />Alderman Ruiz seconded the motion. Following his second, Mr. Ruiz enquired <br />whether aBY of the Councilmen who were not familiar with the facts of the case <br />should be informed. The Mayor gave a chronological resume of the White case. <br />Questions of the new Councilmen were answered by the Mayor and Aldermen <br />Pool and Ruiz. At length, Alderman Whittenberg expressed the opinion that <br />they knew all they needed to know about the case. The question being callcd <br />for, the following vote waS recorded: <br /> <br />AYE; Pool, Ruiz, Serur, Tuttle, Whittenberg <br />NAY: Ncne <br /> <br />The Mayor declared the motion carried. <br /> <br />The City Attorney excused himself from the meeting. <br /> <br />Alderman Whittenberg introduced an Ordinance Amending an Ordinance setting <br />the speed on Highway 123, and moved its adoption. The Ordinance, which was <br />read in full, is attached herewith as a part of the Minutes. Alderman Pool <br />seconded the motion of adoption, and on roll call, the following vote was <br />recorded: <br /> <br />I <br /> <br />AYE: Pool, Ruiz, Serur, Tuttle, \Vhittenberg <br />NAY: None <br /> <br />The Mayor declared the Ordinance Passed, Approved and Adopted. <br /> <br />The City Manager gave a brie~ report on the latest developments in the <br />Camp Gary project, and asked approval of the Council to gc to Washingtcn <br />with the Concept he had prepared.
