<br />I <br /> <br />AN ORDINANCE TO AMEND SUBSECTION 8 a and SUB- <br />SECTION 8 b of SECTION 2 of AN ORDINANCE ADOPTED <br />ON THE 20th DAY OF AUGUST, A.D., 1963, ENTITLED <br />"AN ORDINANCE REGULATING THE SPEED OF TRAFFIC <br />UPON PORTIONS OF U.S. AND STATE HIGHWAYS LYING <br />WITHIN THE CORPORATE LIMITS OF THE CITY OF SAN <br />MARCOS THROUGH THE ESTABLISHMENT OF CERTAIN <br />MAXIMUM SPEEDS FOR PARTICULAR SECTIONS OF SAID <br />HIGHWAYS: ENUMERATING THE HItr!WAYS AND SECTIONS <br />THEREOF WITH THE MAXIMUM SPEED: FIXING PENALTIES <br />FOR THE VIOLATION OF THE PROVISIONS OF THIS ORDIN- <br />ANCE: PROVIDING A SAVINGS CLAUSE: REPEALING ALL <br />ORDINANCES IN CONFLICT HEREWITH: AND ESTABLISHING <br />AN EFFECTIVE DATE.": AND, PROVIDING AN EFFECTIVE <br />DA TE FOR THE AMENDMENT. <br /> <br />~- <br />~I <br /> <br />4 -' / <br /> <br />WHEREAS, it has come to the attention of the Governing Body of the <br />City of San Marcos, Texas, that it is in the best interest of the City of San Marcos <br />to change the present maximum permissive speeds on certain sections of State <br />Highway 123 as they are presently fixed. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the <br />City of San Marcos, Texas: <br /> <br />SECTION 1. Subsection 8.a of Section 2 of the above captioned <br />ordinance adopted the 20th day of August, A. D., 1963, is amended to read as <br />follows: <br />"8. State Highway 123 <br /> <br />I <br /> <br />a. For South Bound Traffic <br />From Station 7+00 (East Curb Line of East Frontage Road of I.H .35) <br />to Station 42+00, a distance of 0.712 mile, a maximum speed of <br />40 miles per hour. <br />From Station 42+00 to Station 50+00, a distance of 0.152 mile, a <br />maximum speed of 50 miles per hour. <br />From Station 50+00 to Station 60+66 (San Marcos South City Limit), <br />a distance of 0.202 mile, a maximum speed of 60 miles per hour." <br /> <br />SECTION 2. Subsection 8.b. of Section 2 of the above captioned <br />ordinance is amended to read as follows: <br /> <br />"b For North Bound T raffi c <br />From Station 60+66 (San Marcos South City Limit) to Station 50+00, <br />a distance of 0.202 mile, a maximum speed of 60 miles per hour. <br />From Station 50+00 to Station 42+00, a distance of O. 152 mile, a <br />maximum speed of 45 miles per hour. <br />From Stati on 42+00 to Stati on 7+00 (East Curb Line of East Frontage <br />Road of I. H. 35), a distance of 0.712 mile, a maximum speed of <br />40 miles per hour," <br /> <br />SECTION 3. An ordinance adopted on the 28th day of October A.D., <br />1963, and all ordinances, resolutions, or parts thereof in conflict with this ordin- <br />ance are repealed only so far as they conflict with this ordinance. <br /> <br />I <br /> <br />SECTION 4. This Ordinance shall be in full force and effect on and <br />after its legal publication as provided by law, and shall remain in effect unti I <br />rl5Cinded by the Governing Body of the City of San Marcos. <br /> <br />PASSED, APPROVED, AND ADOPTED this 20th day of April A.D., 1964, <br /> <br /> <br />
