<br />TWEEN LINDSEY STRE,ET
<br />ANn.. JAMESSTREET;RE-
<br />pEALING ALL ORDINANCES
<br />IN CONFLICT; CONTAINING
<br />A SEVERABILITY PROVI-
<br />SION; PROVIDING A PENAL-
<br />TY FOR VIOLATION; and,
<br />F I X I N G AN EFFECTIVE
<br />DATE HEREOF.

<br />WHEREAS, it has been brought
<br />to the attention of the Governing
<br />Body of the. City of San Marcos
<br />tha t Academy 'Street between
<br />Lindsey Street and James Street
<br />is not of sufficient width to per-
<br />mit the free, passage of two-way
<br />tr~ffic and accommodate parking,
<br />on both sides thereof; - and, ,
<br />WHEREAS, the best interest of I
<br />the publ~c requires that parking
<br />on the above mentioned street
<br />must be 'controlled. 'and regulated.
<br />NOW, THEREFORE, BE IT!
<br />ORDAINED BY THE GOVERN-
<br />ING BODY OF THE CITY' OF
<br />SAN MARCOS, TEXAS,
<br />
<br />Section 1. It shall hereafter be
<br />unlawful to park any vehicle on
<br />the West side of Academy Street
<br />between Lindsey Street and
<br />James, Street.
<br />Section 2. All ordinances and/or
<br />part of ordinances in conflict
<br />herewith are hereby repealed.
<br />Section 3. In the event any
<br />word, phrase, - clause, sentence,
<br />paragraph - or any other portion
<br />of this ordinance shall be judi-
<br />cially determined to be unconsti-
<br />tlllional, .Ineffecllve "" Ilnlawful,
<br />such judicial holding shall not
<br />affect the remaining portion here-
<br />of,
<br />Section 4. Any person found
<br />guilty of violating this ordinance,
<br />or any part thereof, shall be
<br />guilty of a misdemeanor, and,
<br />I upon conviction shall be fined in
<br />the amount not exceeding Two
<br />Hundred Dollars (~200).
<br />Section 5. This ordinance shall
<br />take 'effect 'from and- after its
<br />publication in a newspaper pub-
<br />lished within the City of San
<br />Marcos, Texas.

<br />attention of the Governing Body
<br />of the City of San Marcos, Texas,
<br />that it is in the best interes,t of
<br />the City of San Marcos to chimge
<br />the present maximum permissive
<br />speeds on certain sections of State
<br />Highway 123 as they are present-
<br />ly fixed,
<br />NOW, THEREFORE, BE IT OR-
<br />I DAINED by the Governing Body
<br />of the City of San Marcos, Texas:
<br />SECTION 1. Subsection 8,a. of
<br />I Section 2 of the above captioned
<br />10rdinanCe adopted the 20th day
<br />of August, A.D" 1963, is amended
<br />; to read as follows:
