<br />I <br /> <br />I <br /> <br />I <br /> <br />jq <br /> <br />STATE OF TEXAS <br />COUNTY OF HAYS <br /> <br />I <br />I <br /> <br />THIS AGREEMENT, between Maudean G. Johnston, a resident of San <br />Marcos, Texas, hereinafter called First party, and the City of San <br />Marcos, a municipal corporation located in Hays County, Texas, here- <br />inafter known as Second Party, said Second Party having duly auth- <br />orized its Mayor Pro Tem, Ellis Serur, to execute this agreement by <br />virtue of a resolution of its City Council, WITNESSETH: <br />THAT WHEREAS, First Party is asserting a claim against the <br />Second Party by reason of the following alleged occurrences: Damages <br />claimed by First Party to have resulted to her combined home and <br />place of business, located at 418 North G~dalupe Street, San Marcos, <br />Texas, during the period of time from September 1, 1964, through <br />January 31, 1965, First Party further claiming that such damages <br />were the result of sewerage backing up in the municipal sewer lines <br />and then overflowing upon the above-mentioned premises at different <br />times during the above set out period; and, <br />WHEREAS, there is a bona fide dispute and difference between <br />the parties hereto as to the validity of said claim and the respon- <br />sibility, if any, of Second Party in connection therewith; and, <br />WHEREAS, in order to settle such dispute and difference, the <br />parties have agreed upon a full and final settlement and compromise <br />of the above-described claim and of all the causes of action, damages, <br />liabilities, expenses and costs arising by reason of the occurrences <br />above-mentioned, whether now known or not known to the parties hereto: <br />NOW, THEREFORE, for and in consideration of Six Hundred Fifteen <br />and 50/100 ($615.50) Dollars cash to First Party in hand paid by <br />Second Party, the receipt and sufficiency of which is hereby ac- <br />knowledged by First Party, the said First Party does hereby release <br />the Second Party as well as all other individuals, associations or <br />corporations whatsoever, of and from all causes of action, damages, <br />liabilities, expenses and costs arising by reason of the said occur- <br />rences whether now known or not knownto the parties hereto. <br />
