<br />MARCOS, TEXAS, BY. MAK-
<br />ING IT UNLAWFUL TO
<br />THROW, DROP, PLACE OR
<br />DEPOSIT UPON A STREET,
<br />ALLEY, SIDEWALK. OR OTH-
<br />ER PUBLIC PLACE WITHIN
<br />SAID CITY, .RUBBISH, TRASH,
<br />GARBAGE, ASHES. JUNK OR
<br />OTHER IMPURE, UNSIGHTLY,
<br />UNWHOLESOME OR UNSANI-
<br />TARY MATTER OF AN Y
<br />KIND; PROVIDING FOR A
<br />PENALTY FOR ANY SUCH
<br />VIOLATION; AND CONCLUD..
<br />ING WITH PARTIAL INVALID-
<br />ITY, REPEAL OF CONFLICT-
<br />ING ORDINANCES AND EF-
<br />FECTIVE DATE PROVISIONS.

<br />WHEREAS, it is deemed by
<br />the City Council of the City oE
<br />San M,arcos, Texas, that the
<br />health and welfare of the public
<br />ir.. general and that of the citi-
<br />zens of San Marcos in particular'
<br />is - or will be endangered by the
<br />throwing, placing, dropping, or
<br />depositing upon a street, alley,
<br />sidewalk or other public place
<br />I within said city of rubbLo:;h, trash,
<br />: garbage, ashes, junk or oth,er
<br />impure, unsightly, unwholesome
<br />or uns'anitary mattter of any
<br />kind:

<br />SECTION 1. It shall be. un.
<br />lawful for any 'person, firm or
<br />corporation to throw, place', drop
<br />or deposit l;mon a street, alley,
<br />sidewalk or other public place
<br />within said city, rubbish, trash.
<br />i garbage, a..-:hes, junk .or other
<br />I impure, unsightly, unwholesome
<br />lor unsanitary ffi'atter of any
<br />kind.
<br />SECTION 2. Any person, firm
<br />I' 01' jndividual who shall violate
<br />any provision of this ordinance
<br />shall be guilty of a misdemean-
<br />or, and, upon conviction, shall
<br />il"-be fined in any sum not excee-d.
<br />, ing Two Hundred ($200.00) Dol.
<br />lars.
<br />SECTION 3. In case a viola.
<br />tion of ,any provision of this or-
<br />dinance be by a corporation, the
<br />president, vice-president, secre-
<br />tary, treasurer, manager, agent
<br />Or employee of such corporation
<br />also shall be severally lia;ble for
<br />the penalties herein provided.
<br />SECTION 4, If any part of thi.,
<br />ordinance is, or should be held,
<br />invalid for ilny reason, then that
<br />fact shall not invalidate the en-
<br />tire ordinance, _ but the balance
<br />i of this ordinance shall rem3in in
<br />full force and effect.
<br />SECTION 5. All other ordi-
<br />nances or part.~ of ordinances in
<br />conflict with this ordinance are
<br />hereby repealed.
<br />SECTION 6. This ordinance
<br />shan be in full force and effect
<br />i upon its passage ,and legal publi'-
<br />cation.
<br />PASSED, ARPROVED AND
<br />ADOPTED. this the 8th day of
