<br />AN ORDINANCE DECIARING VACATED, ABANDONED AND CLOSED
<br />CERTAIN PORTIONS OF HAMILTON AVENUE, NEVADA AVENUE,
<br />BIANCO STREET, CENTER STREET, SOUTH STREET, DELMAR
<br />AVENUE AND AN ALLEY BORDERING LOTS 243 THROUGH 246
<br />OF THE Z. WILLIAMSON 3RD ADDITION TO THE CITY OF
<br />SAN MARCOS; AND AUTHORIZING THE EXECUTION OF A DEED
<br />BY THE MAYOR OF THE CITY OF SAN MARCOS TO THE SAN
<br />MARCOS INDEPENDENT SCHOOL DISTRICT OF ANY INTEREST
<br />THE CITY OF SAN MARCOS MAY HAVE IN SUCH PORTIONS OF
<br />SAID STREETS AND SAID ALLEY.

<br />WHEREAS, the City of San Marcos has received, from the San
<br />Marcos Independent School District and John J. Stokes, a petition
<br />requesting the declaration by the City of San Marcos that the here-
<br />inafter described portions of Hamilton Avenue, Nevada Avenue, Blanco
<br />Street, Center Street, South Street, Delmar Avenue and an alley
<br />bordering Lots 243 through 246 of the Z. Williamson 3rd Addition
<br />to the City of San Marcos, henceforth be vacated, abandoned and
<br />closed; and,
<br />
<br />WHEREAS, said petition does further request that the City of
<br />San Marcos execute a deed without warranty, conveying all interest
<br />of said city, if any, in such hereinafter described portions of said
<br />streets and said alley to the said San Marcos Independent School
<br />District; and

<br />WHEREAS, the City of San Marcos, through its agents, has duly
<br />determined that such portions of said streets and said alley have
<br />never been used for any public purpose, will not be used for any
<br />public purpose in the foreseeable future, and that ll; therefore, is
<br />to the interest of the public in general and said city in particular
<br />that such portions of said streets and said alley be abandoned,
<br />vacated and closed, immediately and permanently; and,
<br />
<br />WHEREAS, the City of San Marcos, through its agents, has
<br />duly determined that the said San Marcos Independent School District
<br />and John J. Stokes are the sole owners of all property abutting upon
<br />or against such portions of said streets and said alley:

<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, as follows:

<br />Section 1. That the hereinafter described .portions of
<br />Hamilton Avenue, Nevada Avenue, Blanco Street, Center Street, South
<br />Street, Delmar Avenue and an alley bordering Lots 243 through 246
<br />of the Z. Williamson 3rd Addition to the City of San Marcos, are
<br />hereby declared to be and henceforth shall be vacated, abandoned and
<br />closed as to any use, right or claim whatsoever of the public in
<br />general and the City of San Marcos in particular. The portions of
<br />said streets and said alley so vacated, abandoned and closed are
<br />as follows: ~l) That portion of Hamilton Avenue, as shown on the map
<br />of the Z. Williamson Third Addition of record in Volume 59, page 545,
<br />Hays County Deed Records, bounded on its Southwest side by Lot No.
<br />248 of said addition, on its Northwest side by Clyde Street, on its
<br />Northeast side by Lot No. 249 of said addition, and on its Southeast
<br />side by Block No.4 of the F. P. Dannelly Addition, map of said latter
<br />addition being of record in Volume W, page 405, Hays County Deed
<br />Records. (2) That portion of Nevada Avenue, as shown on ,said map
<br />of the Z. Williamson Third Addition, bounded on its Southwest side by
<br />Lot 254 of said addition, on its Northwest side by said Clyd~ Street,
