<br />AN ORDINANCE RECEIVING CERTAIN TERRITORY ADJOINING THE
<br />CITY LIMITS OF THE CITY OF SAN MARCOS, TEXAS, INTO SAID
<br />CITY OF SAN MARCOS.

<br />WHEREAS, the owners of a strip of land, said strip of land
<br />not exceeding one-half (l/Z) mile in width, being contiguous and
<br />adjacent to the present residents, qualified to vote for members
<br />of the State Legislature, has petitioned the City of San Marcos
<br />to annex said strip of land within its municipal limits, a copy
<br />of said petition being hereto attached and marked as Exhibit "A".
<br />and made a part hereof for all pertinent purposes; and,
<br />
<br />WHEREAS, it will be of signal advantage to the City of San
<br />Marcos to annex said strip of land within its municipal limits; and,
<br />
<br />WHEREAS, the petitioner will install a water line and sewer
<br />line, of a size to be determined by the City, from the nearest
<br />source to the property.

<br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the
<br />City of San Marcos, Texas, that the said strip of land, herein-
<br />after described by metes and bounds, be and the same is hereby
<br />received as a part of the City of San Marcos, and the corporate
<br />limits of the City of San Marcos are hereby extended so as to
<br />include said strip of land, and from henceforth, the territory so
<br />received and annexed shall be a part of the City of San Marcos
<br />and shall be bound by the acts and ordinances of said City in
<br />accordance with law.

<br />BE IT FURTHER ORDAINED that a condition of this annexation
<br />is the installation, by the property owner, of a water line and
<br />a sewer line of a size to be determined by the City, from the
<br />nearest source to the said lots 9 through 16, College Heights
<br />Addition.

<br />SAID STRIP OF LAND IS described by metes and bounds as
<br />follows:
<br />
<br />BEGINNING at a point in the City Limit Line, which
<br />point is the Northwest corner of Lot Zl, Block 1, Forest
<br />Hills Addition, and a point in the Northeast right-of-way
<br />line of North Austin Street; and,
<br />
<br />THENCE, in Northwesterly direction along the North-
<br />east right-of-way line of North Austin Street, N. 450Z1'
<br />West to a point, which point is the most Southerly corner
<br />of Lot 16, College Heights Addition and the point of inter-
<br />section of the Northeast right-of-way line of North Austin
<br />Street with the Northwest right-of-way line of Walnut Street;
<br />and,
<br />
<br />THENCE, in a Northeasterly direction, N. 44039' East,
<br />240 ft. to the point of intersection with the Northwest
<br />right-of-way line of Walnut Street with the Southwest right-
<br />of-way line of Clark Ave.; and,
<br />

<br />THENCE, in a Northwesterly direction along the Southwest
<br />right-of-way line of Clark Ave., and the Northeast property
<br />line of Lots 9 through lZ, College Heights Addition to the
<br />point of intersection with the Southwest right-of-way line of
<br />Clark Ave., with the Southeast line of cardinal Court, also
<br />the most Northerly corner of Lot No. 9 of said College Heights
<br />Addi tion; and,
<br />
<br />THENCE, S. 44039' West along the Southeast right-of-way line
<br />of Cardinal Court, passing through the most westerly corner
<br />
