RESOLUTION I WHEREAS, certain real property owned by the United States of America consisting of pipes, valves, fittings, fire hydrants, and related appurtenances installed and in place on the property, as well as an Easement, twenty feet (20') in width, located in the County of Hays, State of Texas, has been declared surplus and is subject to disposal by the Secretary of Health, Education and Welfare; and, WHEREAS, the City of San Marcos is in need of said property and can uti Iize the same for water transm issi on; and, WHEREAS, it is the desire of the City Council, the governing authority of the City of San Marcos, to make applicotion to the United States Government for acquisition of the property under the provisions of Section 203(k)(I) of the Federal Property and Adminis- trative Services Act of 1949 (63 Stat. 377), as Amended, and regu lations and procedures promulgated thereunder; I NOW, THEREFORE, BE IT RESOLVED by the City Council that B. R. Fuller, City Manager of the City of San Marcos, or his successor in function, be and he is hereby designated as the proper official of said City by whom negotiations for such acquis- itions are to be prosecuted; and he is hereby duly authorized to do any and all things necessary and proper to procure acqusition of and to accept, the property approved for transfer by the Department of Health, Education, and Welfare of the City of San Marcos. BE IT FURTHER RESOLVED that the City of San Marcos is ready, willing and able, and is hereby authorized to pay all external administrative expenses incident to the transfer of said property; and to assume immediate care and maintenance thereof. BE IT FURTHER RESOLVED that three certified copies of this Resolution be furnished to the Regional Representative, Division of Surplus Property Utiliziation, Department of Health, Education and Welfare as evidence of the official action of the City Council of the City of San Marcos in authorizing the application for, and acquisition of said property.
