(, )'wI, I AN ORDINANCE AMENDING SECTIONS 4,14 and 16 OF "AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND; DECLARING THE PURPOSE; PROVIDING FOR CHANGES AND AMENDMENTS; ESTABLISHING AN OFFICIAL ZONING MAP; ESTABLISHING DEFINITIONS; DESIGNATING DIST- RICTS; PROHIBITING USE; PROVIDING FOR NEWLY ESTAB- USHED TERRITGRY; SETTING FORTH USE RESTRICTIONS IN THE SEVERAL DISTRICTS; ESTABLISHING LAND COVER- AGE; PROVIDING FOR PARKING; PROVIDING FOR SET-BACK; DEFINING NON-CONFORMING USES; PROVIDING FOR A BOARD OF ADJUSTMENT; PROVIDING ENFORCEMENTS AND REMEDIES; CLARIFYING CONFLICTING ORDINANCES; PROV/DING FOR A SAVINGS CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE". BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SAN MARCOS, TEXAS, THAT SECTIONS 4,14 AND 16 OF"AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS...ETC." ADOPTED ON THE 9th DAY OF DECEMBER, A.D., 1963 BE AMENDED AS FOLLOWS: SECTION 4: DEFINITIONS: SETBACK: Delete the fol lowing words:" any projection of..." to make the definition read: "The minimum horizontal distance between the front wall of a bui Iding, including steps and unenc J osed porcn., and the front property line." I SECTION 14:LAND COVERAGE: After the words "land area in "D" district" insert the fol lowing: "There shal I be a rear yard in al I "R" districts as defined in Section 4". SECTION 16:SET-BACK: Delete in its entirety and insert the fol lowing: "Uti lity lines, sidewalks and driveways may extend beyond the set-back lines all the way to the property I ine; and roof over-hangs, in- cluding gutters and downspouts, may extend be- yond set-back line up to a maximum of three feet; but no other portion whatsoever of a dwel ling unit shall extend beyond said set-back line. Fences and shrubbery from the street to the set- back line shall not to exceed three feet in height on corner lots nor more than four feet in height on inside lot I ines.
