<br />AN ORDINANCE REQUIRING ONE-WAY TRAFFIC ON CERTAIN PORTIONS <br />OF THE ACCESS ROADS PARALLEL TO INTERSTATE 35; PROVIDING A <br />PENALTY FOR VIOLATION; CONTAINING A SEVERABILITY CLAUSE; <br />AND, ESTABLISHING AN EFFECTIVE DATE <br /> <br />I <br /> <br />Whereas, there are access roads parallel to Interstate 35 <br />on the east and west sides of said Interstate Highway beginning at <br />Loop 82 and running in a generally southerly direction along the west <br />side of Interstate 35 to the Redwood Road, and running in a generally <br />south-north direction along the east side of said Interstate 35 from <br />the Redwood Road to Loop 82, both access roads at the present time <br />having two-way traffic; and, <br /> <br />Whereas, said access roads are not of sufficient width to accom- <br />modate two-way traffic and to permit the parking of vehicles on one <br />side thereof; and, <br /> <br />Whereas, said access roads, used as a two-way traffic artery, <br />create a hazardous and dangerous condition to the extent that human <br />life is endangered by this continued two-way traffic use; and, <br /> <br />Whereas, the safety and best interests of the public can best <br />be served by causing all traffic on said access roads to proceed in <br />the same direction, either north-bound or south-bound, and that parking <br />thereon be prohibited to one side only. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY <br />OF SAN MARCOS: <br /> <br />SECTION 1. The access road running from north to south parallel <br />to Interstate 35 on the west side of said highway is hereby declared <br />to be a one-way street between Loop 82 and the Redwood Road. <br /> <br />I <br /> <br />SECTION 2. The access road running from south to north parallel <br />to Interstate 35 on the east side of said highway is hereby declared <br />to be a one-way street between the Redwood Road and Loop 82. <br /> <br />SECTION 3. All vehicular traffic on said access roads shall pro- <br />ceed from north to south or south to north, as the case may be, and <br />it shall hereafter be unlawful for any person to drive or operate <br />a motor vehicle on said access roads in any direction other than that <br />prescribed in this ordinance and in accordance with the directional <br />signs placed thereon. <br /> <br />SECTION 4. Any person violating any provlslon of this ordinance <br />shall be deemed guilty of a misdemeanor, and, upon conviction, shall <br />be fined in any amount not exceeding Two Hundred Dollars ($200.00). <br /> <br />SECTION 5. If any word, phrase, section, clause, sentence, <br />paragraph, or any other portion of this ordinance shall be judicially <br />determined to be unconstitutional or ineffective, such judicial deter- <br />mination shall not affect any other portion hereof. <br /> <br />SECTION 6.
