RES 0 L UTI 0 II WHEREAS, there is a need to perform engineering services for improvements to the sewage system, water system, and street system including bridges and drainage, for the City of San Marcos, Texas; and, I WHEREAS, the City has accepted the offer of the Community Facilities Administration of the Housing and Home Finance Agency to furnish funds for the preparation of preliminary plans for the above named facilities: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Marcos that Ellis Serur, Mayor, is hereby authorized and empowered to execute on behalf of the City an agreement with Isom H. Bald and Associates, Engineers, of Austin, Travis County, Texas, for said firm to furnish engineering services on the sanitary sewage, water, and street and bridge systems, and said agreement to be sub- ject to the following conditions: 1. That any and all previous agreements between the City and Isom H. Hale and Associates, Engineers, both directly or indirectly, whether by verbal arrangement or by City Council action, or by any other action of anyone, shall be discontinued on the execution of this agreement, and neither the City nor any of its agencies or departments shall be obligated in any way to said Isom H. Hale and Associates for services of any kind previously performed in behalf of the City, nor will Isom H. Hale and Asso- ciates be obligated in any way to the City in regard to any previous work, services, deeds, or acts performed. I 2, That the fees to be paid for the Engineering services to be provided in this agreement shall be in conformance with the current recommended fees of the Texas Society of Professional Engineers for similar work, but in no event shall the fees paid for preparing the preliminary plans exceed, the amounts of advance planning funds offered by the Community Facilities Administration. 3. That provisions be written into this agreement that will permit the City to terminate this agreement at any time upon 30 days duly authorized written notice from the City Council to the Engineer.
