<br />I <br /> <br />I <br /> <br />I <br /> <br />y; <br /> <br />NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that Robert P. <br /> <br /> <br />Lowman, of the County of Guadalupe and State of Texas, hereinafter <br /> <br /> <br />referred to as Lowman, and the City of San Marcos, a municipal <br /> <br /> <br />corporation of Hays County, Texas, hereinafter referred to as City, <br /> <br /> <br />in consideration of the premises and in consideration of the mutual <br /> <br /> <br />benefit to be derived herefram, do hereby agree as follows: <br /> <br /> <br />1. The administration and use of the land conveyed to the City <br /> <br />by the hereinabove mentioned deed. as a municipal airport for a period <br /> <br /> <br />of twenty (20) years from December 4, 1954, shall be considered to <br /> <br /> <br />have been accomplished if the City shall do the following: <br /> <br /> <br />(a) Insofar as all of the real property described in said deed is <br /> <br /> <br />concerned, to keep the average height of allgrass and weeds growing <br /> <br /> <br />or to grow thereon at a level of no more than eight (8) inches above <br /> <br />the ground. <br /> <br />(b) Maintain in good and proper manner, so that same is at all times <br /> <br />suitable for the landing and taking off of aircraft, the real property <br /> <br />described as Runway No. One (1) in the above-mentioned deed, and, in <br /> <br />particular, to so control the growth of grass and weeds in and adja- <br /> <br />cent to said Runway No. One (1) as to retard deterioration of such <br /> <br />runway to the greatest practical extent. <br /> <br />(c) Maintain in good and proper manner the real property described as <br /> <br />Runway No. Two (2) in the above-mentioned deed; and, in particular, <br /> <br />to keep said runway rolled and packed so as to prevent loose gravel <br /> <br /> <br />collecting on such runway to the greatest practical extent. <br /> <br /> <br />(d) Maintain adequate restroom facilities either on the land described <br /> <br /> <br />in the above-mentioned deed or upon other land belonging to the City <br /> <br />and adjacent to the land described in said deed. <br /> <br />2. In the event of City's failure to administer and use the land <br /> <br /> <br />conveyed to it by the hereinabove mentioned deed as above-provided, <br /> <br /> <br />it shall be the responsibility of Lowman to bring any such failure to <br /> <br /> <br />the attention of the City by written communication directed to the <br /> <br /> <br />City Manager of the City of San Marcos.
