<br />I <br /> <br />AN ORDINANCE PROHIBITING THE SALE, OFFER OF <br />SALE, DELIVERY OR GIFT TO ANY PERSON UNDER <br />TWENTY-ONE YEARS OF AGE OF CERTAIN TYPES OF <br />GLUES AND CEMENTS; MAKING IT UNLAWFUL FOR <br />ANY PERSON TO INHALE SUCH GLUES AND CEMENTS; <br />PROVIDING FOR A PENALTY NOT EXCEEDING TWO <br />HUNDRED DOLLARS ($200.00) FOR VIOLATION; AND <br />PROVIDING FOR PUBLICATION HEREOF <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Except as otherwise provided herein, no person shall sell, <br />offer for sale, deliver or give to any individual or individuals under <br />the age of 21 years any glue or cement commonly known as model airplane <br />glue, plastic cement, household cement, cement or any other similar <br />substance, if such glue or cement or any other similar substance contains <br />one or more of the following volatile solvents: <br />(a) Toluol, (b) Hexane, (c) Trichlorethylene, (d) Acetone, (e) Toluene, <br />(f) Ethyl Acetate, (g) Methyl Ethyl Ketone, (h) Trichlorethane, (i) <br />Isopropranol, (j) Methyl Isobutyl Ketone, (k) Methyl Cello solve Acetate, <br />(1) Cyclohexanone. <br /> <br />SECTION 2. The provisions of Section 1 of this Ordinance shall not apply <br />where the glue or cement or any other similar substance is sold, delivered <br />or given simultaneously with and as part of the kit used for the construction <br />of model airplanes, model boats, model automobiles, model trains or other <br />similar models. <br /> <br />II <br /> <br />I <br /> <br />SECTION 3. It shall be unlawful for any person to inhale any glue or cement <br />containing one or more of the solvents named in Section 1 hereof with the <br />intent of obtaining an intoxicating or narcotic effect thereby. <br /> <br />SECTION 4. Any person who shall violate any of the provisions of this <br />Ordinance shall be deemed guilty of a misdemeanor and) u~on conviction <br />thereof, shall be punished by a fine not to exceed $200.00. <br /> <br />SECTION 5. If for any reason any section, paragraph, subdivision or clause <br />of this Ordinance shall be held invalid, such shall not affect any other <br />provisions of this Ordinance. <br /> <br />SECTION 6.
