<br />RES 0 L UTI 0 N <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />That, in order to comply with the laws and regulations <br />governing the Department of Housing and Urban Development <br />Water and Sewer Faci lity Grant Program, the land acquisition <br />policy of the City of San Marcos, Texas, such policy to be in <br />ful I force and effect throughout the entire course of its <br />obtainment of land for the extension of its water and sewer <br />faci I ities, wi II be as follows: <br /> <br />I. It will make every reasonable effort to acquire by <br />negotiat~dpurchase before instituting eminent domain <br />proceedings al I real property that it finds necessary <br />to obtain under said program. <br /> <br />2. It wil I not require any owner of such real property <br />to surrender possession thereof until it pays, or ~auses <br />to be paid, to such owner (a) the agreed purchase price <br />arrived at by negotiation, or (b) in any case where only <br />the amount of the payment to such owner is in dispute, <br />not less than 75% of the appraised fair value as approved <br />by it and concurred in by said Department of Housing and <br />Urban Development, <br /> <br />3. <br /> <br />It wi 1 I not require any person lawfully occupying property <br />to surrender possession thereof without at least ninety <br />days written notice from it of the date on which possession <br />wi I I be required. <br /> <br />I <br /> <br />PASSED AND APPROVED th i s 30th day of January, A.
