<br />~/ <br /> <br />5. If an examination of the title to said real property by <br />the attorney for said City discloses any defects in said title which <br />cannot be cured to the satisfaction of said attorney within a reason- <br />able time, then the consideration paid for this option is to be re- <br />turned to said City, and all rights and obligations created hereby <br />shall be terminated. <br /> <br />I <br /> <br />6. Possession of said real property shall be given to said <br />City upon consummation of purchase. <br /> <br />7. All taxes due upon the above-described real property up <br />to the consummation of my purchase thereof, if any, will be discharged <br />by me. All taxes due upon such property after the consummation of my <br />purchase thereof will be discharged by said City. <br /> <br />8. In the event that I have purchased the above-described <br />real property from the said Sarah D'Spain prior to the consummation of <br />purchase between said City and me, all interest that I am required to <br />pay on a note which I may execute to cover the whole or any part of <br />the $10,800.00 which I pay to the said Sarah D'Spain for said real <br />property, shall be discharged by said City. In addition, any expenses <br />accruing in connection with financing the purchase of said property <br />from the said Sarah D'Spain shall be discharged by said City. <br /> <br />9. In the event of consummation of purchase between said <br />City and me, all moneys collected by me for the rental of the above- <br />described real property up to the time of consummation of such pur- <br />chase shall be the property of said City less a sum equal to ten (10) <br />per cent of the total amount of said rentals and less any expenses of <br />maintaining said premises. <br /> <br />10. If said real property is damaged prior to consummation <br />of purchase, the above-set-out consideration shall be decreased by the <br />amount of insurance claim settlement. <br /> <br />, <br /> <br />11. This agreement shall inure to and be binding upon the <br />parties hereto, their respective heirs, executors, administrators, <br />successors and assigns. <br /> <br />12. The above-mentioned contract between the said Sarah <br />D'Spain and me is hereto attached and made a part hereof for all <br />pertinent, legal and descriptive purposes. <br /> <br />WITNESS my signature to duplicate copies, each of which shall <br />have the same force and effect, this the day and year first above <br />written. <br /> <br />~7{ ~~ <br /> <br />, <br />
