<br />ÖRDINANCE 1981-44 <br /> <br />75 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE CODE OF <br />ORDINANCES OF SAID CITY TO ADD A SECTION 2-5 <br />TO ESTABLISH A FEE IN THE AMOUNT OF TEN DOLLARS <br />($10.00) TO BE ASSESSED AGAINST PERSONS SUBMIT- <br />TING CHECKS TO SAID CITY WHICH ARE RETURNED TO <br />SAID CITY BECAUSE OF THE REFUSAL OF THE PAYOR <br />FINANCIAL INSTITUTION TO PAY THE ITEM AS DRA~iN <br />AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the workload of City of San Marcos employees <br />involved in the processing and collecting of checks which are <br />returned from financial institutions is increasing and such <br />processing and collecting work is a significant problem in the <br />cashier area; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />believes, and so finds, that a fee established by the City which <br />would compensate the City for the employee time spent in processing <br />and collecting returned checks would reduce the number of such <br />"bad" checks; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Code of Ordinances, City of San Marcos, <br />Texas, is hereby amended by adding a section, to be numbered 2-5, <br />which said section reads as follows: <br /> <br />Sec. 2-5. Fee for processing checks returned because <br />of refusal of payor financial institution <br />to pay item. <br /> <br />(a) There is hereby established a fee in the amount <br />of ten dollars ($lO~OO) which shall be assessed <br />each person who submits a check to the City of <br />San Marcos, Texas, as payment for an obligation <br />to said City which is subsequently returned to <br />said City because of the refusal of the payor <br />financial institution to pay the item as drawn. <br /> <br />(b) For purposes of this section, "person" shall <br />include an individual, corporation, governmental <br />subdivision or agency, business trust, estate, <br />trust, partnership or association, or any other <br />legal or commercial entity. <br /> <br />SECTION 2. That this Ordinance shall be in effect ten days <br />from and after its passage and publication in a newspaper of <br />general circu~ation in the area. <br /> <br />PASSED AND APPROVED on first reading May 11, 1981. <br /> <br />PASSED AND APPROVED on second reading May 18, 1981. <br /> <br />PASSED, /\APPROVED AND ADOPTED May 26, 1981. <br /> <br />~ <br /> <br /> <br /> <br />Berry R.
