Peters, Trustee, to purchase 20 acres, <br />more or less, of land. The Authority thought the option covered <br />all three tracts of 2.00, 18.13 and 0.75 acres out of the J. M. <br />Veramendi Survey No. Two which are set out in the plat I gave <br />you prepared by Forrest Scott. As you know, the Authority has <br />received final approval for the project. <br /> <br />In examining the title to the three tracts it was recently dis- <br />covered that Doyle S. Peters, Trustee, does not own the 0.75 <br />acre tract but that the City of San Marcos does. Somehow, there <br />was a serious misunderstanding. <br /> <br />In December of 1966, James Tuttle bought the 23.3 acre tract <br />shown by the Scott plat. In May and June of 1967, he conveyed <br />4.11 acres out of the northeast corner thereof to Mrs. E. C. <br />Frisbie. On October 16, 1967, he conveyed the 18.13 acre tract <br />to Doyle S. Peters, Trustee, and the 0.75 acre tract to the <br />City of San Marcos for street purposes for the use of the Peters <br />and Frisbie tracts. The latter conveyance was a gift to provide <br />Tuttle's grantees with access to Loop 82. Tuttle had previously <br />secured permission from Dr. James McCrocklin on behalf of S.W.T. <br />S.C. for the City to use a 44 foot strip belonging to the College <br />between the 0.75 acre tract and Loop 82 in return for the convey- <br />ance by Tuttle to S.W.T.S.C. of 9 feet along the northwest side <br />of his 23.3 acre tract. <br /> <br />The Housing Authority incorporated said 0.75 acre tract into its <br />plans, but specifically noted the importance of not allowing the <br />tract to be used for street purposes so as to permit traffic to <br />pass through the development between Loop 82 and Thorp Lane. The <br />Housing Authority's plans have been approved all the way up to <br />Washington D.C. <br /> <br />So you can see that the Authority must either acquire the 0.75 <br />acre tract, or a substantial part of it, or amend and resubmit <br />its plan, which would necessitate a delay of three ot four months <br />and possibly jeopardiZe approval of the development. <br /> <br />V [I \, '~ ::; <br /> <br />i '} I <br /> <br />
