<br />OF THE CITY OF SAN MARCOS, TEXAS.

<br />"Upon motion duly made, seconded and unanimously carried, the
<br />following resolution was adopted:

<br />"RESOLUTION
<br />
<br />"A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN
<br />THE CITY OF SAN MARCOS, HUGHSON HEIGHTS, INC., AND GONZALES COUNTY
<br />SAVINGS AND LOAN ASSOCIATION, WHEREIN THE CITY OF SAN MARCOS WILL
<br />EXTEND ITS SEWER AND WATER MAINS TO THE SUBDIVISION KNOWN AS HUGHSON
<br />HEIGHTS, AND WILL INSTALL A SEWAGE COLLECTION AND WATER DISTRIBUTION
<br />SYSTEM WITHIN SAID SUBDIVISION; HUGHSON HEIGHTS, INC., WILL PAY THE
<br />CITY OF SAN MARCOS $135,537.60 FOR THE INSTALLATION OF SAID SYSTEM;
<br />GONZALES COUNTY SAVINGS AND LOAN ASSOCIATION WILL LEND HUGHSON HEIGHTS,
<br />INC., SAID SUM OF $135,537.60; AND THE CITY OF SAN MARCOS, FOLLOWING
<br />ITS RECEIPT OF SAID $135,537.60, WILL REBATE A MAXIMUM OF ONE-HALF OF
<br />SAID $135,537.60 TO HUGHSON HEIGHTS, INC.; ALL ACCORDING TO TERMS AND
<br />PROVISIONS SET FORTH IN SAID AGREEMENT.

<br />"BE IT RESOLVED by the City Council of the City of San Marcos,
<br />that an agreement be executed between the City of San Marcos, Hughson
<br />Heights, Inc. and Gonzales County Savings and Loan Association, wherein
<br />the City of San Marcos will extend its sewer and water mains to the sub-
<br />division known as Hughson Heights, and will install a sewage collection
<br />and water distribution system within said subdivision; Hughson Heights,
<br />Inc. will pay the City of San Marcos $135,537.60 for the installation
<br />of said system; Gonzales County Savings and Loan Association will lend
<br />Hughson Heights, Inc., said sum of $135,537.60; and the City of San
<br />Marcos, following its receipt of said $135,537.60, will rebate a maxi-
<br />mUlTI of one-half of said $135,537.60 to Hughson Heights, Inc., all as
<br />set forth in a copy of said agreement, same attached hereto, and made
<br />a part hereof for all pertinent, descriptive and legal purposes, such
<br />agreement to be referred to for the terms and provisions governing such
<br />extension installation, payment, loan and rebate.

<br />"BE IT FURTHER RESOLVED that the Mayor of the City of San Marcos be,
<br />and he is hereby authorized and directed, to execute, acknowledge and
<br />del iver said agreement to Hughson Heights, Inc., and Gonzales County
<br />Savings and Loan Association, in return for their execution, acknowledge-
<br />ment and delivery of same to the City of San Marcos, said Mayor being
<br />further authorized to do all things necessary to carry out the terms and
<br />provisions of said agreement."

<br />I, Dorothy O. Worrell, Secretary of the City of San Marcos, do hereby
<br />certify that the above foregoing is a true and correct excerpt from the
<br />mi nutes of a meet ing of the City Counc 11 of the Ci ty of San Marcos, duly
<br />held after proper notice on the ',:;<I",j- day of March, 1968, that the
<br />action reflected by said minutes has in no way been changed, altered, modi-
<br />fied, rescinded or amended, and that I am the custodian of said minutes.
<br />The agreement to which this certification is attached is a verbatim copy
<br />of the agreement which was before the City Council and being considered by
<br />said Council when it took the action above set forth.
