<br />AN ORDINANCE ACCEPTING THE CONVEYANCE
<br />OF A PARCEL OF LAND OUT OF BLOCK NO.2,
<br />J. S. TRAVIS ADDITION, SAN MARCOS,
<br />TEXAS; DEDICATING SAID PARCEL OF LAND
<br />TO THE PUBLIC FOREVER TO BE USED AS AN
<br />ALLEY; AND DECLARING AN EMERGENCY.
<br />
<br />WHEREAS, H. Y. Price Enterprises, Inc., has heretofore conveyed
<br />Ita the City of San Marcos, Texas, that 2638 square foot parcel of land
<br />hereinafter described by metes and bounds, the instrument effecting
<br />such conveyance being dated the 26th day of ~, 1967, and recorded
<br />in Volume 218, pages 149-151, Hays County Deed Records, to which con-
<br />veyance, and its record, referance is here made for all legal, pertinent
<br />and descriptive purposes; and
<br />
<br />WHEREAS said, 2638 foot parcel of land was secured by the City of
<br />San Marcos, Texas, for the express purpose of making same a part of the
<br />street and alley system of the City of San Marcos;
<br />
<br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
<br />San Marcos, Texas, that conveyance of the 2638 foot parcel of land
<br />hereinafter described by metes and bounds and above referred to, be,
<br />and it is hereby, accepted as a part of the street and alley system of
<br />the City of San Marcos, and that said 2638 foot parcel of land further
<br />be, and it is hereby, dedicated to the use of the public as an alley
<br />forever.

<br />Said 2638 foot parcel of land is described as follows:
<br />That certain parcel of land out of Block No.2, J.S. Travis Addition
<br />to the City of San Marcos, Hays County, Texas, said subdivision of
<br />II record in Volume 0, Page 203, ~ys County Deed Records, and;
<br />
<br />BEGINNING at an iron stake set on an old fence line on the East
<br />line of Fredricksburg Street as recognized and used upon the ground,
<br />for the Southwest corner of the tract herein described, same being
<br />the Northwest corner of that tract of land described in a deed of trust
<br />from Mrs. Mary Crunk, a widow, to Fred C. Morse, a trustee, said deed
<br />of trust dated February 8, 1960, and recorded in Volume 93, page 599,
<br />Hays County Deed of Trust Records, and from which beginning corner an
<br />old axle found at the intersection of the South line of Comal Street
<br />and the East line of Fredricksburg Street as recognized and used upon
<br />the ground, for the Northwest corner of said Block #2, J. S. Travis
<br />Addition, bears N 70 38' w. 171.33 ft;
<br />
<br />THENCE leaving Fredr.icksburg Street with old fence line, N 830
<br />22' E. at 79.17 ft. passing an iron stake set at base of corner post
<br />for the Northeast corner of the said Mrs. Mary Crunk tract, and con-
<br />tinuing on in all 158.33 feet to an iron stake set on the West line
<br />of a public alleyway as recognized and used upon the ground, for the
<br />Southeast corner of the tract herein described;

<br />THENCE with the West line of the said public alleyway, N. 70 38'
<br />W 16.66 feet to an iron stake set for the Northeast corner of the tract
<br />herein described;
<br />
<br />THENCE leaving alleyway, S. 830 22' W. 158.33 feet to an iron
<br />stake set on the East line of Fredricksburg Street as recognized and
<br />used upon the ground, for the Northwest corner of the tract herein
<br />described;
<br />
<br />THENCE with the saidEa~ line of Fredricksburg Street, S. 70 38'
<br />E. 16.66 feet 'to 1Jl:ie plac.e of beginning, containing 2638 sq. ft of land.
