<br />shall violate a prov~s~on of this Code, or fail to comply therewith,
<br />or witb any of the requirements thereof, or who shall erect, construct,
<br />alter, demolish or move any structure, or has erected, constructed,
<br />altered, repaired, moved or demolished a building or structure in vio-
<br />lation of this Code, shall be guilty of a misdemeanor. Each such per-
<br />son, firm, corporation or agent shall he deemed guilty of a separate
<br />offense for each and every day or portion thereof during which any
<br />violation of any of the provisions of this Code is committed, or con-
<br />tinued, and upon conviction of any such violation such person, firm,
<br />corporation or agent shall he punished by a fine of not less than Ten
<br />Dollars ($10.00) and not more than Two Hundred Dollars ($200.00). The
<br />imposition of the penalties herein prescribed shall not preclude the
<br />City of San Marcos, Texas, from instituting an appropriate action or
<br />proceeding to prevent an unlawful erection, construction, reconstruc-
<br />tion, alteration, repair, conversion, maintenance or use, or to restrain,
<br />correct or abate a violation of this Code, or to prevent the occupancy
<br />of a building or structure or portion thereof, or of the premises, or
<br />to prevent an illegal act, conduct, business or use in or about any pre-
<br />mises.

<br />(b) Section 306.2 of said Code is amended so that it will
<br />now read in full as follows: Every dwelling unit shall contain at
<br />least four hundred (400) square feet of habitable floor area.
<br />
<br />Section 3. Nothing in this ordinance or in the code hereby adopt-
<br />ed shall be construed to affect any suit or proceeding not pending in
<br />any court, or any rights acquired or liabiliity incurred, nor any cause
<br />or causes of action accrued or existing, under any act or ordinance
<br />repealed hereby. Nor shall any right or remedy of any character be
<br />lost, impaired, or affected by this ordinance.
<br />
<br />Section 4. The invalidity of any section or prov~s~on of this
<br />ordinance or of the code hereby adopted shall not invalidate other
<br />sections or provisions thereof.

<br />Section 5. All ordinances or parts of ordinances in force at the
<br />time that this ordinance shall take effect and inconsistent herewith
<br />are hereby repealed.

<br />Section 6. The public welfare, health, peace and safety being
<br />presently endangered due to the fact that the existing ordinances of
<br />the City of San Marcos, Texas, do not afford an adequate and compre-
<br />hensive code governing the use, occupancy, and maintenance of dwel-
<br />lings, dwelling units and accessory structures within the corporate
<br />limits of the City of San Marcos, Texas, therefore, an emergency is
<br />apparent, requiring the provisions of the Charter of the City of San
<br />Marcos, that ordinarily require ordinances to be read on three several
<br />days and that no ordinance shall become effective until the expira-
<br />tion of ten (10) days following the date of its final passage, be dis-
<br />pensed with; thus, this ordinance shall be effective following a single
<br />reading and passage thereof by this body, the City council of the
<br />City of San Marcos, Texas, and its publication in a newspaper of gen-
<br />eral circulation within the City of San Marcos. Such publication
<br />shall be accomplished by a setting out in said newspaper of the cap-
<br />tion and the penalties for violation of said ordinance.
